Sit Down Mr. President!

In light of the recent dictates on contraception, religion and health insurance emanating from the White House, I believe that it is time to review the duties, responsibilities and authorities of the office of the President of the United States of America. The office of the President and its attendant powers are set out in Article II of the Constitution, and it's a very short Article. The President is the executive officer of the agencies of the Executive Branch of the federal government. He is not the executive officer of the Congress, the federal Courts, the States, individual citizens, private businesses or private organizations. Thus he may direct the activities and spending of those federal agencies under his control, but that's it. He cannot direct anyone else or anything else to spend or not spend or do or not do anything. Period. All of this huffing and puffing about directing churches or religious benevolent organizations or insurance companies to provide this or that or spend this or that is just downright silliness. Beyond his executive duties for federal agencies his few responsibilities mostly relate to defense, foreign policy negotiations, appointing judges and signing or vetoing legislation. I don't see running churches, charitable organizations or private insurance companies in that list. His law enforcement and legal agencies may investigate violations of federal law, bring perpetrators to justice and try such cases in federal court; but the President may not amend federal laws on the fly. This idea behind an all-powerful Presidency is what drives the move to abolish the Electoral College. Forces in this country would like to elevate the President to a virtual dictator or king with power over all aspects of the federal government, state governments, individual citizens, private business and private organizations. These forces would like to move to popular election of the President, ignoring the fact that the President is elected by the States to serve the United States of America. The People's direct representation in the Federal Government is the House of Representatives, the People's House. The President's role and influence has grown far beyond it's original intent and far beyond a safe and sane level. It is time to return the office of the Presidency to it's proper and limited role in our government, our businesses and our personal, private lives.

Obama Assault on Religion

This assault on First Amendment Freedom of Speech and Religion by this lawless, unconstitutional, anarchist, fascist so-called Obama Administration is an abomination. He has crossed a line and dropped his guard and revealed his true self. This is an assault upon the United States of America proper. This administration has become a clear and present threat to the U.S. Constitution and the U.S. Republic. Barack Hussein Obama has thrown the U.S. Constitution on the floor and crapped on it! There is no constitutional basis for this (and many previous) actions by this president. And don’t throw the lame, tired Interstate Commerce Clause defense up. That’s laughable. And yes, the federal government has the authority to tax…but ONLY for legitimate Article 1, Section 8 enumerated powers. PERIOD! The majority of American people are finally wise to these realities and the phoniness of this administration. And they’ve had enough. The only hope this Republic has for survival are civil disobedience and State Nullification. If the several States will exert their superior power (after all it’s the States who created the federal government to SERVE them) under the Tenth Amendment, we may preserve the Union. If not, I fear all is lost. There is no hope or solution In Washington, D.C. In fact D.C. is the source of all of these problems. The President, the Congress and the Courts have abdicated their Constitutional authority and failed to serve the People. They should all step aside out of a sense of honor and duty.

If the people and the Congress and the President want the federal government to do a thing and most people agree that it's probably a good thing, but the Constitution does not specifically empower the federal government to do this thing in Article 1, Section8; what should the feds do?

A) Encourage the individual States to do this thing if they so desire.
B) Begin the process of passing a constitutional amendment to empower the federal government to do this thing.
C) Do Nothing.
E) Just go ahead and do it anyway, after all it's a good thing and the federal government can do virtually anything and everything it wants under the Interstate Commerce Clause and the Necessary and Proper Clause.

Folks, all this stuff you've heard about Conservatives not wanting to fight, wanting to stay out of the media, is a lot of horse dung. Conservatives, traditionally, love to fight. All real Conservatives love the sting of debate.

When you were kids, you all admired the champion marble shooter, the fastest runner, the big league ball players, the toughest boxers. Conservatives love a winner and will not tolerate a loser. Conservatives play to win all the time. Now, I wouldn't give a hoot in hell for a candidate who lost and laughed. That's why Conservatives have never lost and will never lose a debate. Because the very thought of losing is hateful to Conservatives.

Now, a movement is a team. It lives, eats, sleeps, fights as a team. This individuality stuff is a bunch of crap. The bilious journalists who wrote that stuff about individuality for the Saturday Evening Post don't know anything more about real elections than they do about fornicating.

Now, we have the finest ideas and philosophy, the best spirit, and the best people in the world. You know, by God, I actually pity those poor Liberals we're going up against. By God, I do. We're not just going to beat the Liberals. We're going to cut out their ideological guts and use them to grease the commentary of our think-tanks. We're going to outnumber those lousy Libtards by the bushel.

Now, some of you folks, I know, are wondering whether or not you'll chicken-out under fire. Don't worry about it. I can assure you that you will all do your duty. The Liberals are the enemy. Wade into them. Spoil their ballots. Shoot them down on the telly. When you put your hand into a bunch of poo that a moment before was your best friend's business, you'll know what to do.

Now there's another thing I want you to remember. I don't want to get any messages saying that we are holding our position. We're not holding anything. Let the Libs do that. We are advancing constantly and we're not interested in holding onto anything -- except the Liberals. We're going to hold onto them by the nose, and we're gonna kick them in the ass. We're gonna kick the hell out of them all the time, and we're gonna go through them like crap through a goose!

Now, there's one thing that you folks will be able to say when you get back home, and you may thank God for it. Thirty years from now when you're sitting around your fireside with your grandson on your knee, and he asks you, "What did you do in the great 2012 Presidential Election?" -- you won't have to say, "Well, I voted for a RINO Republican."

Corporate Teambuilding Warning

At the Friday staff meeting the boss excitedly announces that in two weeks the department is going to take a day off-site for teambuilding activities. The extroverts are jumping for joy inside, oh boy; a day of fun and games! There is a collective internal groin from the introverts, crap; maybe I can call in sick that day. The poor clueless boss has no idea what disaster is brewing. He went to a conference or read a book or was advised by someone in HR that this would be a great thing for his group. Just the thing to whip up morale and boost productivity. So what’s the problem?

As best I can determine psychology tells us that your personality is pretty much established by the time you are five or six. And it seems that most of this is hard-wired, not so much learned or influenced by the social environment. Which means that it’s really not going to change, no matter how many books your read or seminars you sit through. People can be taught to try to mask their personality or fake it, but that usually never actually works well. They tend to overcompensate and it just comes out weird, everyone can tell. There are many models for describing personality types, but I am just going to stick with simple, generic introvert and extrovert. Just convert to whatever model you favor; the principles are pretty much the same.

It seems clear to me that society is generally structured around extroverts. That is held as the de facto normal or correct personality type. Introverts are looked on as a bit weird, eccentric; not really conforming to the norms of most of society. They are quiet and withdrawn and shun interpersonal interaction and relationships. Why don’t these people like others? There must be something wrong with them, maybe an abused or dysfunctional past or family life growing up. The extroverts plot to fix them; we must help them come out of their shell into the bright light of day! They obviously aren’t having fun (as defined by the extroverts, of course), and to extroverts having fun is always the ultimate goal. How could anyone have fun all by themselves? The solution? Teambuilding!

I’m not here to bash all teambuilding, it’s not all bad and it does have a role in corporate America. But only if crafted properly and presented in a way that takes into account the different personalities of the group and does not put undue pressure upon people to do or say things that are phony or threatening to them. One problem I see is that bosses or hiring committees generally do not make a serious effort to understand the psychological profile of the job and match it to someone whose personality fits that profile. So we wind up with introverts in jobs that are best suited to extroverts and vice versa. Some workgroups are nearly solely introvert types, think software engineering while others are solely extrovert driven, think customer service representatives or sales. And of course others are blends of both. The savvy boss understands this before filling these positions and is careful to find people with the right personality for the job. Ah, if only it were so. Unfortunately, that’s probably not usually the case. So now we have mismatched jobs and employees and we’re going to throw that mix into teambuilding activities. Watch out! A lot of these people are already stressed and professionally unhappy because they are in a job that their personality is not suited to. They will try to succeed by faking it, conforming, putting on a mask, reading books, going to seminars or even employing coaches to try to be something they simply are not. The solution is to try to find a better job fit. But back to teambuilding.

I find that most teambuilding programs are written and facilitated by extroverts. And, probably unintentionally and unaware; most are written for extroverts. Well, think about it; who would write teambuilding for introverts? That’s an oxymoron. It would basically be, sit in your cube and read a book! Sales teams love teambuilding games, the engineers will hide under their desks. So why do we keep trying to put square pegs into round holes? Because the extroverts over in HR tell us that we need to have these days for the good of the team and the organization. After all, they heard it at a conference from some expert (extrovert) who wrote a book about it. He has a consulting business and a website so he must be right. Forcing the introverts in the workgroup to put on a smile and participate in all of these activities can lead to unwanted behaviors and comments as well as bad feelings and damaged relationships. They may poison the activity, make rude comments about the stupidity of the activity or just throw up their hands and walk away, refusing to participate. Bosses and facilitators may see this as childish, disruptive behavior and resort to coercion or threats of disciplinary action in an attempt to get them to ‘work together as part of the team.’ They may be shocked at this behavior in someone who has been a good employee and never acted like this before. What they don’t realize is that the introvert is displaying an ego defense mechanism under extreme stress and anxiety to try to protect their psyche. They are not being intentionally uncooperative or disruptive; they are trying to keep from blowing a gasket. So the boss or facilitator must ask themselves what is really to be gained from forcing someone to do something they are really not suited for. Is the employee and the group really better off? Has morale and productivity improved? Probably not, actually it may now be worse. This can create a lot of confusion and misunderstanding amongst the members which wasn’t there before.

So what to do? Well, from the get-go try to hire the right person for the job. This will go a long way to maintaining a productive, pleasant work environment. Introverts can work with others effectively, even with extroverts; but they function best when not being expected to act and perform like an extrovert. Subtle social pressures will certainly undermine this, as can calling them out in teambuilding activities. When introverts are in introvert jobs and extroverts are in extrovert jobs the wheels will turn much more smoothly. Let the extroverts gravitate to each other and let the introverts be loners. Don’t take it personally, it’s not. Remember, when it comes to extroverts and introverts it’s not a matter of good or bad, right or wrong; just different. Use the differences to your benefit. The extroverts are great at working with the public and cheerleading new products. The introverts are great at getting the details done behind the scenes. Just tell them what you want, what resources they have and when it’s due then get out of the way (as much as is possible), leave them alone and you’ll get the results you want. The introverts and extroverts will collaborate when necessary, just as long as it’s on their terms, not artificially contrived. And when it comes to teambuilding, remember some people like to be on the field under the lights competing to the cheers of the crowd, while others just like to sit in the stands and watch.

The Evil Among Us

Needless to say, we are all heartbroken about the tragedy in Norway. As a parent hardly anything I can think of would exceed the sadness of losing a child. The stories of the kids trying to escape the island are horrific. What comes to mind is the question of why, apparently there was no armed security or anyone on the island carrying a weapon who might have been able to intervene sooner than the ninety minutes it took the police to get onto the island? I know the whole idea of having armed security around, particularly around kids gives some people the heebie-jeebies, but how many kids might be alive today had there been armed guards on the island? At my church, where we had fatal shootings several years ago we have armed police and armed plain-clothed security at all of our events. Some people that it's horrible to have weapons and guards at a church service. Some think it's non- or even anti-Christian. They argue that it violates scriptures, that Jesus would never approve. On the contrary, I believe that Jesus would encourage us to protect our women and children from the evil intents of bad people. And as we have personally experienced, churches (and kids' camps and shopping malls) are not sacred ground; they are not safe from acts of violence. To leave oneself and one's family unprotected simply because "it's church after all" is naive, irresponsible and frankly cowardly. The simple fact is that law enforcement cannot protect people at the moment of crime. That's not their primary responsibility and the resources do not exist to carry out such a monumental charge. The presence of an effective police force to track down criminals and bring them to swift and certain justice can be a powerful deterrent, but will not stop all people with evil, violent intent from carrying out their crimes. Some individuals are simply crazy and others have evil agendas and will stop at nothing to carry through with them. Thus, individual citizens must be prepared, in many different ways to avoid and deal with crimes against their persons, families and property. Yes, that may mean legally carrying a weapon, being trained in its proper use and being willing to use it if necessary to defend themselves and their family. This is a mature understanding of the world we live in and the responsibility of defending what is yours. There have always been evil people with violent criminal intent in the world, they exist today and will always be with us. To naively think that we live in such enlightened times now that we can ignore these unsettling realities and eschew the messy business of defending ourselves is self-deceptive and dangerous. Sadly, we can see the results in Norway. Let this be, if anything good a wake-up call to dozing people and societies around the world to squarely face the realities of the modern world and take appropriate steps now to avoid another tragedy of this nature in the future. Good bless the families and friends of the lost and my prayers for the injured for quick and complete recoveries.

We Are Keeping Score

It's not about keeping score, Democrats vs. Republicans. It's not about who has compromised or given up or gotten more or less. It's not about Congress or the Senate or the President. It's not about you or Boehner or Reid or Pelosi or McConnell or Obama. It's about the PEOPLE dammit! And the DEBT, the SPENDING, the DEFICITS, the COUNTRY and the FUTURE! And the CONSTITUTION! It's time the federal government sacrifices. Sacrifices it's sacred cow programs and profligate spending and reckless fiscal irresponsibility. The people should not and will not sacrifice for mistakes not of our making, they are your mistakes. You fix them. Now. Cut trillions this year and for every year as far as the eye can see and pay down and eliminate the monster debt that you all, Republican and Democrat alike created. If you all don't and don't do it now and fast and fully, you are ALL out next election. There is another American revolution brewing, mark my words. Either get on board or get run over!

Absolute Power Corrupts

Proponents of a weak, 'living,' evolving Constitution love to reference the concept of the 'general welfare' which appears in a few locations in the Constitution as justification for such programs as MediCare, Social Security, a federal minimum wage and ObamaCare; for which otherwise there is no specific justification in the enumerated powers of Article 1, Section 8. Firstly, it appears in the Preamble, which; any student of law should be able to tell you confers no power or authority. Preambles are merely statements of intent not empowerment. The phrase also appears in Article 1, Section 8 under the power to lay and collect taxes clause. It is important to remember that in the late 18th century the word 'welfare' meant something different that what we generally use it for today. Back then, 'welfare' meant a general state of well-being. It certainly did not mean, as we regularly use it today to mean entitlement payment or transfer payment or other financial support given as a gift from the national treasury from tax revenue. General welfare in 1787 referred to things that would benefit the country generally as a whole, such as the powers and duties enumerated in Article 1, Section 8 of common defense of our national borders against threats, the coining of money, the raising of armies and navies, the establishment of post offices and roads and the establishment of a system of federal courts; to name a few. The concept of the general welfare as used by liberals today is meant to confer federal benefits on individuals for their personal welfare and financial support. This is a very different concept indeed. But it is this concept of the 'general welfare' that liberals use to justify these federal entitlement programs that otherwise do not appear in the list of enumerated powers. In essence this is the golden net, the catch-all phrase to justify federal meddling (taxing and spending and regulating) in areas that really are not specified and authorized by the Constitution. It really opens up the Pandora's box and permits the government to anything it darn well pleases. (The Interstate Commerce Clause is the other part of this power grab, but that's a different topic for a different day.) But that begs the question. If the drafters had intended to give the new centralized federal government authority to do anything and tax and spend for virtually anything, why bother to write the list of enumerated powers in Article 1, Section 8 and why include Amendment 10 which grants powers not specifically delegated to the federal government by the Constitution to the States? Under the liberals' twisted logic, nothing is prohibited of the federal government by the Constitution. And to further clarify, the Necessary and Proper clause ONLY authorizes the Congress to make laws for the execution of the powers outlined in the Constitution (back to Article 1, Section8). If the federal government were to be all powerful (as liberals seem to posit) the Constitution would have been a very much shorter document (We establish a federal government to do anything it wants). This idea flies in the face of the beliefs and intents of the Founders as is clear in their writings preceding and surrounding the time of the writing of the Constitution. They were supremely skeptical of a strong centralized government. So they set out the specific enumerated powers, reserved the rest to the States and established a rather unwieldy process for making changes. The Constitution evolves only when it is formerly amended. The problem for liberals is that this process is long and hard and rarely succeeds. As it should be. Our fundamental framework of federal government should not be changed frequently and for dubious reasons. It should not change with the whims and winds of the day. If it were constantly changing, there would be no certainty for tomorrow on which to make plans today. Of course this is the great impediment for progressives (like Obama) who want to make sweeping wholesale changes in our society and government and get it done yesterday. Amendment just doesn't suit that plan. So, they have used the courts to subvert (at least in their minds) the meaning of the Constitution, bending and twisting it to suit their needs. Thus Justice Douglas found his mysterious penumbras and emanations. Today this has been taken to new heights with President Obama and his administration and some in Congress simply ignoring the Constitution altogether, thus bypassing the judicial process and speeding up the transformation. This bodes for dangerous and dire times ahead. Who holds their feet to the Constitutional fire?

You know, when I was in high school and college studying hard there were a lot of kids cutting classes, smoking, drinking and carousing. They partied every night and many dropped out. I skipped a lot of the parties and got good grades. I went on to medical school and became a doctor. Now a lot of those people vote for Obama and demand that he take my money that I work hard for and give it to them. They say that I have been lucky in life and that they have simply been unlucky. Yeah, I've been lucky if luck is a four letter word spelled W-O-R-K. And they are unlucky if that is a four letter word spelled L-A-Z-Y. So there it is.

A government that has the power to dictate your light bulb choices and to compel you to buy health insurance has the power to control, regulate and dictate every aspect of your life. Is this what the Pilgrim’s loaded into the Mayflower, crossed a merciless sea and faced an unknown world of harsh conditions and menacing savages for? Seriously, this is why they came to the New World? Our Founders fought off the tyrannical yoke of King George just so that they could regulate trans-fats? The men who wrote the Declaration of Independence, won a revolutionary war and then established a constitutional republic had a healthy distrust of strong centralized government power and an unwavering respect for religious freedom, personal property and individual liberty. The current administration has demonstrated an insatiable appetite to regulate and dictate every aspect of our personal lives in direct violation of their responsibilities and constraints as clearly outlined in the Constitution. They seek to circumvent the constitutional limits placed upon their power by imposing myriads of extra-legal rules and regulations and fines through bureaucracies and agencies which have no legislative authority. They command people and businesses through intimidation, confusion, complexity, threats, fear and bluffs. They demean and disparage people who cling to the actual wording and intent of the Constitution. These people are called hicks and hayseeds and throwbacks and outdated anachronisms. The Constitution is referred to as either a living, breathing document subject to endless reinterpretation by liberal, activist judges to mean whatever is expeditious to their cause at the moment; or an old, dead document written by dead white men in an old language that no one today can understand which might have meant something 200 years ago, but is without relevance today. They completely ignore the fact that the framers understood this evolutionary reality and provided the amendment process just for this eventuality. Wisely, the framers made this process just difficulty enough that it could not be employed for capricious, fleeting fads of the day. But this is just too inconvenient for the libs. Better and quicker to have judges impose dictates and legislate from the bench. Let’s face it, to the Obama administration, the Constitution is nothing more than dirty, used toilet paper. Such a rogue administration, in the interest of promoting ‘The General Welfare,’ will try to impose any and every possible progressive policy and program upon a nearly helpless populace. Under this tyranny abortion is celebrated but you go to jail if you kill an endangered mouse or cut down a tree on your own property without a government permit. Here’s what’s coming, mark my words. You must drive a hybrid car and let us control the thermostat on your home furnace. It’s now illegal to buy Edison’s light bulb, instead you must use the expensive one with the funny glow that blows up and spews mercury all over your kids. If they can’t get Cap and Trade environmental legislation through Congress, no problem just instruct E.P.A. to enact it as a regulation and presto!, Al Gore’s carbon credit business takes off. You can still buy cigarettes (they need the tax revenue, and hey, most libs smoke), but you can’t smoke anywhere, including your own car or house. You can still buy booze (tax revenue again, and who can forget Ted Kennedy?) and now marijuana, but not trans-fats, Happy Meals or salt (unless you’re Barack and Michelle Obama, ribs anyone?). Coke or Pepsi, we’ll decide for you. If you’re a Christian (and yes, most of our Founders really were) keep it in the church and keep your mouth shut about it and keep your shirts and crosses out of the schools, work places, public parks, government buildings and proceedings and Friday night high school football games. The government will dictate to G.M. (Government Motors) how many Volts to build and then when no one buys them they will regulate gasoline cars out of existence. Oh you don’t have to give up your car, but they will just regulate the domestic oil industry out of existence and drive up the price of gasoline until no one can afford it. They refuse to enforce our borders and sovereignty and then arrest our border agents when they shoot drug-running illegals in the butt. We the people wind up paying for housing and transportation and food and medical care for illegals who break our immigration laws, come here and take our jobs. Then, instead of prosecuting and deporting these illegal invaders, this administration wants to reward them with amnesty and a fast-track to citizenship (thereby guaranteeing a new voting block of entitlement-driven supporters). This administration is printing and borrowing money, spending and racking up debt at a dizzying and unprecedented rate, almost certainly guaranteeing national insolvency, collapse of our currency and runaway inflation. They are systematically taking over our health care system, thereby controlling one-sixth of our economy and having control over beginning and end-of-life issues for population control and meeting financial targets. Is there any evidence that anyone in government knows more or is better at managing our health care industry that those people actually working in the industry every day? No! Where is the evidence, what is the track record? Medicare is broke. Medicaid is broke. Social Security is broke. They dictate to banks to make bad loans and then when the banks fail the feds step in, bail them out and take over the mortgage banks and the loans. Guess what, the federal government now owns most loans (and homes) in America. Gee that’s comforting. There is no nook or cranny of your life safe from this marauding band of control freaks. There is a word that describes this type of government-industry complex: fascism. Don’t flip out, I am not saying that Barack Obama is Adolph Hitler, but his policies are fascist pure and simple. For some reason he hates the way this country is structured and is dead-set on ‘transforming’ America. He has elevated class warfare and racism and religious intolerance to new levels. He is the most un-American and anti-American President I believe that we have ever had in office. Nobody had ever heard of this guy and he had never done or accomplished anything before George Soros catapulted him onto the national stage with all of that ‘Hope & Change’ and ‘Yes We Can’ baloney. There is no substance there. Just promise the masses bread and circuses. We are at a crucial point in our nation’s history. If this collective mind-set is allowed to continue running our government and our lives I sincerely believe that the United States of America is doomed. We must dispatch this evil administration and all of its minions to the dustbin of history in the next election (sooner if we can get the Congress and Courts to do the right thing) or I fear we face some sort of civil war or see states begin to separate. Good, hard-working Americans are not going to tolerate this foolishness and live under a boot of tyranny. Enough is enough. The line in the sand has been crossed. May God have mercy upon us all and bless America once again.

Capital Offense

I am just back from a visit to our nation’s capital, Washington, D.C. Walking around town it’s hard not to be struck by the sheer enormity, inertia and energy of the whole endeavor. Having said that, I must also report that the city is a jumbled mess of contradictions, juxtapositions and hypocrisy; starting simply with the streets. They must have been laid out by a drunken sailor. Diagonal streets intersect square grids creating a dizzying mess for the accidental foot traveler. Start out going straight up one street and you can suddenly find yourself on a completely different street without ever noticing a change in direction. And don’t forget whether your hotel is in the NW, NE, SW or SE quadrant. Geez. Now, there are many parks, statues and memorials scattered all over town. Study these memorials and you find that they are dedicated to the memory of many brave, courageous and wise founders and fighters for our country. Strangely, there are no monuments to the ‘great’ compromisers and timid consensus builders; the whimps and wusses of our national heritage. Wonder why that is? One street is populated by foreign embassy after foreign embassy, another by every conceivable public interest and advocacy association and organization known to man. And all of them clamoring for what? Your federal tax dollars that’s what! While you could say that the business of this town is government, and I guess that is technically true; today government is merely a euphemism for other people’s money. When you look around this city and give it some thought, there really are no great leaders or visionaries here anymore. Virtually everything done here really just comes down to moving money around; rewarding this group, punishing that one. Administrations change and the direction of money movement changes course. That’s all. Different players, same song. The role of Congress today sadly is to merely play elves to the President’s Santa Claus. It’s Christmas every day here! (Except that you can’t say ‘Christmas’ anymore) You walk by these monstrous, gaudy, ostentatious federal office buildings and realize that they are just brimming over with bureaucrats whose only job is to find ways to make our lives more difficult and find creative ways to get at our money. They don’t create anything, not wealth; they suck it out. They don’t make things better or easier for people, they just make things worse. I sincerely believe that we could level all of these boring, gray federal buildings and send all of these teeming masses of leeches out into the countryside to find real jobs and everything in our nation would instantly get better. It is easy to see how someone could spend their entire life inside the beltway, as they say; never having to cross the Potomac and having no idea that there is anything of any importance beyond the district boundaries. Some of them probably believe that there is nothing but wilderness and Indians from D.C. all the way to the Pacific! They spend all of their time running around in circles in the city, talking to each other and telling each other how great and important they are. Full of sound and fury and signifying nothing. It is the most self-absorbed city and population one can imagine. That and a dollar will get you a cup of coffee at Denny’s. LOL! And then you come to Fort White House. Literally a fortress within the city. How sad that our nation’s leader is virtually a prisoner inside a jail in the city that is our country’s capital. How ironic, he is arguably the most un-free person in the land! And right across the street from that jail are multitudes of homeless people sleeping in the gutters, literally a stone’s throw from the most powerful person in the world. If he can’t do something about that (compassion?) should we expect him and his government to truly ‘help’ any of the rest of us? Umm, no. The funny thing is that they will look you right in the eye and say that they can and will help you while carefully just outside the screen shot are testimonies to the fact that in reality he cannot and will not. He is powerless. The ultimate irony. Nothing more than a straw man, a straw leader, a straw President. But no one will tell him that he has no clothes. His handlers constantly whisper in his ear how important and powerful he is. You see, by building him up they keep their cushy jobs and coveted parking spots. The simple reality is that I am not impressed by the people working in this town; Presidents, Senators, Congressmen, Supreme Court Justices, Cabinet members or bureaucrats. For the most part they are here just there promoting themselves and their personal agendas. It’s not about the Constitution and the Republic, it’s only about them. They will lie, steal and cheat to get what they want. It is a town of outrageous irresponsibility gilded with soaring rhetorical crap. I shudder at the prospects for the future of the Republic.

Just who the hell is the FCC?! A bunch of unelected, unaccountable bureaucrats acting unconstitutionally. They don't have this power or authority, and frankly neither does the Congress. And the Congress certainly can't delegate these kinds of powers. What is the controlling legal authority here? And please don't insult my intelligence by dragging out the Interstate Commerce Clause! That is the most lame, pathetic and moronic justification you people always fall back on. Give me a million breaks!
Secondly, under the Fourteenth Amendment equal protection clause, if you are going to (for the sake of argument, even though it is actually unconstitutional) give some citizens certain benefits you must extend those same benefits to all U.S. citizens equally. To not do so is to illegally create different classes of citizens with different rights and privileges, something that cannot occur under our constitution.
I am serious as a heart attack about all of this. This is what the Tea Party is all about. Returning to the legal, legitimate federal powers enumerated in the Constitution; and nothing more. This would eliminate about 70% of federal spending immediately. Good! We will prevail, just you watch and see!

$3.8T Total spending

it turns out that the deficit spending is 73% of tax revenue (income).

If a family makes $25K, they would be spending $43.25K using the federal budget percentages.
$50K income would be $86.5K in spending.
$75K income would be $129.75K in spending.
$100K income would be $173K in spending.

Sign me up!

We must return to the Constitution to dictate and limit federal spending.
We must also come to grips with the entitlement monster. Now reports show that one-third of all wages paid in the United States are actually welfare payments! Yikes!

Paying the Piper

Ah, to be in Washington when the President’s budget is released. What better way to forget Valentine’s Day than by looking at barrels of red ink? To sum up, it weighs in at about $3.73 trillion with a deficit of only a mere $1.65 trillion this year, more than a third of the budget. It cuts nothing really and relies on many new taxes. The projection is for nearly trillion dollar deficits for the next 10 years, bringing our national debt to $26 trillion then, up from $14 trillion now; of which Obama has added $4 trillion in the last two years. The House Republicans talk of trying to pare anywhere from $35 billion, to $50 billion, to $100 billion in the best of scenarios. That’s what, 1, 2, 3%? WOW! That sort of draconian slashing will right our sinking ship in no time, right? NOT! Who knows if cutting 40 or 50% now would even stop the inevitable? Our current national debt is now more than our annual GDP and service on the national debt in ten years will be almost a trillion dollars a year. You can’t just monetize that without triggering hyperinflation, you can’t tax people that much and you certainly won’t be able to borrow all of that from the Chinese. After all, they own a big chunk of the debt to begin with. And we haven’t even discussed the fact that in ten years we will be square within the throes of the baby boomers retiring and accessing MediCare. That means that Social Security and MediCare are headed for certain insolvency. Not to mention the big ObamaScare question mark. Needless to say, this kind of social entitlement spending, these deficits and the ensuing national debt are simply unsustainable and intolerable. They will undoubtedly lead to financial collapse and social chaos. The dollar is already teetering today. Throw into that mix the uncertainty of events in the Middle East and the effects that could have on the price of oil, which ultimately affects the price of everything else and we have a recipe for disaster.

So how have we come to this lowly state? The answer is really quite simple but the ramifications are enormous. The federal government has ventured into spending for things for which it has absolutely no constitutional authority. Things such as MediCare, Social Security, farm subsidies, the Department of Energy, the Department of Education and ObamaScare, just to name a few. So much of what the federal government spends trillions of dollars on has no legal basis in the constitution. And the expenditures for these boondoggles grow exponentially far beyond their original projections. Yet, with a lackey Supreme Court and neutered governors and state legislatures this federal juggernaut just careens on down the highway with a drunk at the wheel heading straight for a bridge abutment. Wake up Ralph, because this is going to be quite a crash to see! The only medicine for this ailment is to admit that these and other costly federal programs are constitutionally unauthorized and financially unsustainable. The federal government must bow out of these programs as quickly and fairly as possible. Many of the functions could, and should be assumed by the various state legislatures. This would provide exactly what our founders intended, many state laboratories around the country trying different approaches to see what does and does not work. Government solutions which are closer to the people. And sometimes the solution might not be a government one at all. The private sector is amazingly flexible when not fettered by onerous government regulation.

Lying to the people and forestalling the inevitable reality of our situation does not solve anything. The sooner we face the stark truths about where we are and what must be done the sooner we can take the medicine and get about the task of righting our ship. The longer we wait the harder and more expensive it will be. And we are rapidly approaching the point of no return. Let’s pray that we can knock some sense into the collective heads of the Republicans and Democrats in Washington and the 50 state capitals before we see pitchforks in the streets.

Federal Spending is NOT the Problem...

The only big ticket item that the federal government is authorized to spend money for is defense. Period. Not Social Security nor welfare nor Medicare nor farm subsidies, etc. I would wager that upwards of 75% of federal government spending is unconstitutional. Prove me wrong!

Time to Set Our Compass

All of this talk by RINO's about repealing ObamaScare because it is bad economics or using it as 'foundation' for more tinkering with our health care system totally misses the point and sets us up to be used as 'useful/useless' idiots by the liberal progressives to further their heinous agenda. ObamaScare must be repealed because it is simply UNCONSTITUTIONAL in toto. The federal government has absolutely no constitutional authority or power in the arena of health care. Period. It's not really complicated. At this point in time health care policy is strictly a State function. As it should be. If the other side wants federal power over health care policy the very first step must be a constitutional amendment. Let's see them propose that. And I would throw Medicare and Social Security into the same mix. I know that the Supreme Court has ruled in that past on those programs, but the court is made of up fallible people, not gods. And they DO have their own personal political agendas, all of the protestations about objectivity to the contrary not withstanding. Courts have certainly been overturned by Congress and subsequent courts. The basis for ruling that these programs are constitutional usually revolves around Congress' taxing authority. As I have argued prior the power to tax is not synonymous with the power to spend. The taxing authority is to support the legitimate, constitutional powers of the the federal government. It is not carte blanche to spend money on anything they darn well desire. If so, why have Article 1, Section 8 in the Constitution? This reasoning defies logical thought. What if Congress raised tax money from all of the citizens and then spent it to hire thugs to break the kneecaps of their political opponents? They can't do that we would scream, breaking kneecaps is illegal! Ah, they would reply, we are doing this under our taxing authority. Say what?!
The Constitution is our fixed point of reference in law and government. Without it we are not a nation of laws, but rather a nation governed by the whims of men. This is a recipe for disaster. And that is where we are headed, and have been for years. Think of it this way. In the Christian world the Holy Bible is the fixed point of reference. It is considered the revealed, inerrant Word of God. It is not changeable by men. It is not subject to their interpretation. If it were, Christianity would not be a religion of God, but rather of pastors. And that would be a recipe for disasters. If I can pick up my fixed point of reference and move it, then it's not really a fixed point of reference. It's not really of much help in troubled times. What if the North Star kept moving? How would mariners navigate? What if the lighthouse on the rocks kept moving? How many ships would wreck? When our Constitution is treated like Silly Putty we are adrift in a dangerous sea with no North Star and no lighthouse. We are rapidly approaching the rocks and don't seem to realize it.
The ends do not justify the means. We must follow our constitutional dictates if our republic is to survive. The states are the great laboratories of freedom. Let them deal with the health care questions and see what works best. Then other states can duplicate the best programs.
Keep the feds out and freedom and diversity will solve our problems.

Stir the Pot

I hear so much talk from Barry and his minions in Congress about doing so many good things for the collective good of the people--for society. When I start hearing politicians talking about the collective I get the heeby jeebies. Haven't we heard this before? It's like dejavu all over again.
The first thing that bothers me about this is having politicians determine what is 'good' for anyone. What that really means is what will help the politician get re-elected and line their pocket with money. Period. That's the only 'good' they know. This is why we have checks and balances and limited, enumerated powers in the Constitution. Now if we could only get them to obey those dictates. But that's a topic I have already opined on repeatedly in this blog. Something about a nation of laws, not men. Our Constitution lays out what is good for the nation. We don't need politicians trying to throw in their two cents. I really don't want or need other people deciding what is 'good' for me.
The other challenge with this is having politicians trying to define just who or what exactly is society, or the collective. Does it self-define? Is it just intuitively obvious? I think in reality politicians tend to define the collective as whatever group they are trying to pander to at the moment for, here it comes; votes and money. There really is no great amorphous, homogenous society with all the same needs and wants at the same time. We are a bubbling cauldron of individuals and various interest groups who shift and move and change and meld and dissolve and come back together again in differing forms over time with our own personal changing needs and desires. You can't really take a snapshot at one moment in time and say, aha! that is the collective society and these are its needs and so based upon that, I; beneficent politican will go forth and do 'good' for it (and maybe help me in the process).
So the 'collective' and the 'good' are really only aritifical creations of polticians at any given moment in time which in reality wind up only promoting what is best for the politician; and their wants and needs (votes and money).
When you hear politicians talking about these things, run away, run away!

The Means Justify the End?

I detect an insidious mentality permeating the federal government, particularly the Obama administration and the Congress. It is the idea that the authority to tax, granted by the 16th Amendment is an automatic authority to spend that money on anything at all. This has led to a backwards approach to government spending, i.e.; Congress decides that it wants to spend money on some program (for which there is no Article 1, Section 8 authority) and then simply justifies the decision based upon its authority to raise taxes (in their mind for any foolishness they desire). The means justifies the ends. Congress needs to understand that the power to tax means that Congress has the authority to raise taxes to fund the legitimate, constitutional functions of the federal government (Article 1, Section 8 again). It does not mean that Congress can fill a bucket with tax dollars and then spend them willy nilly on every silly thing that comes to mind. If we are to preserve, indeed save our Republic we must insist that the Congress understand that the Preamble to the Constitution is just that, a Preamble which in legal terms carries no empowering authority but is merely a statement of why the following document (which does include empowering language) is being written; that the 16th Amendment empowers the federal government to raise taxes only for its legitimate Article 1, Section powers; that their specific powers and authorities reside in Article 1, Section 8; that the Necessary and Proper Clause merely authorizes them to enact laws to carry out their legitimate, constitutional powers in Article 1, Section 8; and that the Interstate Commerce Clause is a very narrow and specific clause relating to preventing States from erecting undo burdens to commerce, not granting Congress unlimited power to do virtually anything it wants. If that were the intent of the writers, why have Article 1, Section 8? That sort of begs the question.
Short of reigning in the scope of the federal government along the lines of the preceding provisions, I see no hope of salvaging the idea of the Republic of the United States IN America and most likely the federal government will collapse under the weight of unsustainable taxation, spending, debt and entitlement.
Wake up!

Why Do Rich Liberals Hate Rich People?

I am convinced that there must be a logic gene in the brain and that it is most assuredly missing in liberals. How else could one explain the phenomenon of someone looking at history, be confronted with facts and then completely ignore it all and arrive at a screwball conclusion devoid of any logical explanation?
Several years ago I was chewing the fat with a liberal colleague and the discussion swung around to the topic of the progressive income tax. If you are ever in need of some cheap fun just watch a liberal try to explain the logical basis of this iconic institution and then figuratively explode at the end! Personally, I believe that if conservatives cannot win the arguement against progressive income tax rates, then we probably will never win any substantial governing majority for any length of time. To me, this is a seminal issue that separates the mindset of the two warring parties. Someone's attitude towards this seemingly minute point of policy reveals the fundamental orientation that individual's outlook and perspective on nearly every question of governance.
It is quite clear that the 14,000 or so pages of federal tax code really have little to do with raising revenue and so much to do with the raw exercise of power, with control, with social engineering and with rewarding and punishing friends and political enemies. If it is only about raising revenue we could have a post-card flat tax or a sales tax and be done with it. No, the tax code is powerful tool for inciting class envy, class warfare and for buying votes.
Back to my friend. The crux of our disagreement was, of course over the concept of a system of increasing tax rates for increasing income levels. Thus, the 'progressive' income tax. The liberal argument quite simply put is that those who make more should pay more. They should give back to society. They should pay, hold your breath, their fair share. At this point I drew out the following scenario:

$10,000.00 x 10%=$1,000.00
$100,000.00 x 10%=$10,000.00
$1,000,000.00 x 10%=$100,000.00

I ask him, at a flat 10% tax rate who is paying more? Silly question. The person making a million bucks a year is paying a lot more than the person making a hundred grand and a heck of a lot more than the 'little guy' making ten grand. Isn't that progressive, isn't he giving a lot back, isn't he paying his fair share? Well, not to the liberal's satisfaction. And why not? Well the millionaire can afford to pay a higher percentage of his income, he replies. How do you know, I ask? Well, he should be able to the liberal snorts back. Why should he have to, under what Constiutional principle and more importantly who is to decide how much is enough, I shoot back? Well, the government, of course will decide. So, will it be 20%, 30%, 50%? This is where the control comes in. Whoever sets the rates controls the taxpayer. Whose money is it I ask? Well, it's his money, but he has a responsiblity to plow more of it back into society since he took so much out of society. And here is a fundmental liberal misundersting of economics. It's the idea that when someone gets more, someone else must get less. The rich get richer and the poor get poorer. The zero-sum pie game. What the liberal does not understand is that rich people are usually in business...the business of making more economic pies. Their business activity increases the wealth of everyone. They create jobs, they create goods and services that people want, they spend their income on houses and clothing and cars and boats that must be manufactured, thereby creating more jobs. And all of these people with jobs are paying taxes. A rishing tide does lift all boats. The liberal simply does not see or does not believe all of this and thus thinks that society must wrest some retribution from the rich by imposing every-increasing taxes on them. All that does is take more money out of their pot with which to expand their businesses and hire more people. The liberal winds up killing the golden goose and doesn't even know it.
This is all very interesting, but for me a more fundamental question is that of how we justify treating people differently in the eyes of the tax law. It's a very American tenet that all men are created equal and that all men are treated equally before the law. To not do so is to set up a class system of favoritism and thus fan the flames of class envy and hatred. The liberals are quite adroit at setting up big business and the rich as the boogey-man (you know those big businesses that give people jobs and create new medicines and make your cars and clothing and tv sets and food) and convince the masses that these people are ripping them off and the liberals must ride in to save the day and protect the 'little guy.' Somehow the liberals convince people that by sticking it to the fat cats somehow the little guys will be better off. But when rich people pay more taxes it doesn't put a single dollar in the average little guy's pocket. But he is supposed to feel better about America for some reason. So if you take the time to study the Declaration of Independence and the Constitution you find that an overarching theme is the equality of all people. We are to all be treated equally. There is no royalty or nobility by simple virtue of birth. The rights we hold to be self-evident are for all Americans equally. Lady justice is blind. It doesn't matter if you are a pauper or a President, the law looks at you the same. The law is supposed to be the great equalizer. Yet, for some strange reason when it comes to income tax law, some of us are more equal and less equal than others. The tax rates and income levels they apply to are completely arbitrary and change with the whims of changing political administrations. There is no rhymm or reason to it. And that's just the tax rates. The other 13,999 pages of tax law amounts to the exceptions and exemptions and favors and punishments that politcians dole out to their friends and enemies. Some fairness, some equality. What the politicians (mostly liberal) have done is to pit one class of society against the other; then they play the middle and keep getting re-elected. Fanning the flames of class hatred keeps them empowered. They must be there to protect the little guy from the big, bad businessman. All the while taking huge campaign contributions from the big, bad businessman trying to buy one of those exemptions. I'll take loopholes for $300 million Alex. This tap dance is divisive and runs counter to what is really in all Americans' best interests. This sort of philosophy doesn't usually end well. Think of the Bolshevik revolution in Russia. That ended of with a country that could not even feed itself and tens of millions of citizens slaughtered by their own governement.
Is this where we're headed all over the concept of 'the fair share?' The problem with the fair share is that it really is not fair by any logical deduction and someone must arbitrarily decide what it is. When someone gets to decide what someone else's fair share is there will never be peace and there will certainly never be fairness or equality. The Constitution provides no guidance on how to treat people unfairly and unequally. It's, well; un-American. Perhaps we should not even try.
So now, my liberal friend is just about to the point of exploding. He still thinks that the rich should pay more than their fair share, well just because, um, well, just because. It just seems right to him, besides they can afford it. Oy, here we go again.

My New Year's Resolutions for the Federal Government

1) Abolish lame-duck sessions of Congress or seat the new Congress immediately after the election.
2) Transition to a Flat or Fair-Tax (NOT a V.A.T.); eliminate the graduated income, estate and capital gains taxes.
3) Go back on the gold standard.
4) Abolish anchor babies, seal the borders and enforce the immigration laws currently on the books.
5) Give the President the line-item veto.
6) All new bills in Congress will be one bill, one topic, one vote.
7) All bills in Congress must explicitly cite the Article 1, Section 8 authority for any new government program, spending or legislation. (Hint: ObamaScare, Social Security and Medicare; just to name a few, have none)
8) Adhere to the strict, limited and original text and meaning of the Interstate Commerce Clause.
9) Abolish the unconstitutional precedent of executive branch agencies implementing rules, fees, fines and penalties. Only Congress can make law and there is no provision in the Constitution for Congress to delegate that authority.
10) The Constitution requires that the President be a natural-born United States of America citizen, but makes no process for certifying that stipulation. Congress should enact legislation that requires prospective presidential candidates to certify their birth status by a legally recognized method to their respective party officials, to Congress, to the Supreme Court, to the State Governors and legislatures and to the people at large through the media prior to their nominating convention.
11) All legislation must treat all citizens, companies and institutions equally; no special treatment, no special punishment, no special sweetheart deals and no exceptions for anyone.
12) All members of the federal government; whether elected, appointed, contracted or hired shall be equally subject to all laws of this country. Period.
13) Audit the Federal Reserve and abolish its autonomous authority over our currency.

We are told repeatedly by the lame stream media that Barack Obama is certainly the smartest President in the history of our republic. We are told that he is the most ardent communicator ever.
Well, I think I smell a rat.
If this imposter is so smart why has he not permitted his undoubtedly stellar school transcripts to be released? Modesty? Please! If this guy's grades were really all that outstanding they would have run off several million copies and would be throwing them out of airplanes by now.
First black president of the Harvard Law Review. How convenient.
Great orator? Without his precious teleprompter he can't string together a simple grammatically correct English sentence. That monotone sing-song delivery puts me to sleep within two minutes. And who told him that your inflection is supposed to go up at the end of every sentence? Good grief! Ronald Reagan has nothing to fear.
Genius? Just listen to him answer off-prompter questions which were not submitted for review in advance. Pathetic. He becomes totally incoherent.
I get the sense that he really has no interest in actually governing. He has no knowledge or interest in foreign policy or affairs.
Now the tough part.
I firmly believe that he is our first affirmative action President. Someone who was intentionally slid through the system with less than mediocre credentials just for this moment in time. No wonder the liberals and progressives are cheering him. This is what they have pushing on us for the last 50 years. Finally success! Affirmative action taken to the pentultimate culmination!
And for what purpose?
Now it gets really dicey here.
I think that Obama was put (yes, put) into the Presidency under these circumstances to coerce, and perhaps shame the country into agreeing to de facto reparations for slavery by a variety of income redistribution schemes including the tax code, various entitlement programs, ridiculous stimulus spending, health care reform and cap and trade, to name a few. And that's it. He really has no other purpose and has no other interests. If it takes one term, fine. It might take two. He really has no say it and frankly couldn't care less. He and Michelle are just along for the ride and the bennies. What a scam!
Well, the country is waking up to this farce of an administration and are about to pull the rug out! The jig is up!

Sunset on Sunstein

So Mr. Cass Sunstein (an Obama advisor) thinks that the Constitution was written with disappearing ink, today nothing more than a blank canvas on which he and his cronies can paint a new American landscape. Not a document of absolutes, not even a document of suggestions; but rather a document of outdated platitudes written in a language that no one understands or speaks any more. Thus his posse must come along and essentially rewrite and redefine what America is and is to be. But why his posse and not mine? If the document is meaningless and must be reconstituted then who is to say who gets to do the job? Why does Sunstein have the final say about who has the final say? Doesn't sound like he's being very, um, democratic.
I for one would vote to keep what we have and just simply return to following exactly what it says. If it does need to be updated (and it has been 28 times so far) the drafters clearly spelled out that process. It's called amending. Not letting five people in black robes change it and not letting the President or Congress change it. The people and the states must play a pivotal role. As it should be. The bottom line is that Sunstein thinks that you and I are too stupid to either understand the current constitution or write a new one. In reality what he's really all about is radically transforming America into something it was never meant to be. He wants to establish a socialist state where he and his ilk can control everything and take everything from anyone producing anything and give it to his lazy, non-productive followers. We've seen this movie before and it doesn't end well for anyone. The only problem is the current constitution stands in the way of this megalomaniacal scheme and the legislative process is too slow and uncertain, the legal process is too slow and uncertain and the amendment process is too slow and uncertain for he and his lackeys. They want radical change and they want it now! Just dump the whole document now and impose their one-sided tyranny upon the unwashed masses. Well I sense that a lot of the masses, maybe even a sizable majority want no part of this heinous plot. The election of socialist/progressive Barack Obama and the introduction of crackpots like Sunstein onto the national scene is the lowest point our republic has reached since the Civil War.
The great silent majority is rising up and will be heard this November and in 2012.

How did it come to pass that those of us who understand and respect our national history and founding, who respect the rule of law, who respect and obey the Constitution and who believe in personal freedom and liberty have come to be vilified in the mainstream media and political establishment as wacko, radical, extreme, fringe kooks and nuts? All the while those who reject our history, flaunt the rule of law, ignore the Constitution and would restrict personal freedom and liberty are heralded as the true American patriots and the only rational thinkers and rulers in our society. The world is turned upside down. Right is now wrong, good is now bad and up is now down. What is the allure of such bastardized thinking?
I believe that it derives from the natural human tendency to envy those who have more or better than you and a desire for them to improve their lot at your expense without going through the traditional and time-consuming route of education and long, hard work. Our education establishment in cahoots with the media and political establishments have conditioned people to assume victim status if they don't have enough stuff. They have taught people to demand entitlements which are nowhere guaranteed in the Constitution. This gnawing class envy mentality is dragging down our whole society and economy. Political opportunists gladly seize on this tension to empower themselves by promising free largess to millions of disgruntled citizens; buying their votes with hand-outs. William F. Buckley, Jr. once remarked that when the middle class discovers that they can vote themselves goodies from the public treasury the republic is doomed. How close are we to that prophecy?
The Constitution was written to try to protect these eventualities from coming to pass. Unfortunately, when those in power gleefully ignore the dictates of the this, the Supreme Law of the Land and We the People seem to have no recourse to force their compliance (two hundred years of elections and the problem is only growing worse); what are we to do to save the republic? We don't seem to be keeping it very well Mr. Franklin. Do we really want to become one of those creaky, rusty insolvent European socialist countries? Just look around, they don't work!
The people, the states and state governments must reassert their rightful authority over the federal monster and reinstate the Constitution! Now!

A Tale For Two Cities

It has become quite clear to me that the people of this nation are dividing into two distinct camps. One group wants the federal government to control and regulate everything; wages, salaries and profits while providing everything from health care to food to housing to transportation to education and beyond. The other camp wants exactly the opposite. "Don't tread on me!" They want the federal government to do no more than is expressly authorized in the Constitution. Period. The first group doesn't even know what the Constitution is, have never read it, couldn't find a copy if their life depended on it. And they don't give a rip. To them the nation is the federal government and the federal government is the nation. Some dusty old scrap of paper written by racist, slave-owning rich white men over two hundred years ago has no relevance for their lives. Constraints upon the power and size of the federal government seem strange and ridiculous to them. They don't understand all of the fuss about "States' Rights" and can't quite grasp why some states allow things and others don't. To them this whole business of dividing the country up into different states with different rules and laws makes no sense; it confuses them. I believe that many of them really believe that the states are merely administrative subdivisions of the federal government, that they in essence work for the federal government much like counties are subdivisions of state governments. This first group doesn't understand why anyone would want to limit the scope and power of the federal government. Why, isn't that just limiting what it can give you and do for you? This is what decades of pathetic (intentional or unintentional?) education of our children in the areas of American history, heritage, economics and government has led us. Sadly, far too many people have no idea how or why this nation came to be. They have no concept of what is required for successful self-government. They do not understand how wealth is created or exactly what money is and where it comes from. The relationship between business and labor and capital completely eludes them. This first camp is the 'entitlement at any cost' camp. They willingly surrender all of their freedom, liberty and wealth to the federal government in exchange for a guarantee (now that's rich) of security and provision (however meager) for their entire lives. They wind up with no control or responsibility for what happens to them. Like lemmings over the cliff. As the old saw says, the man who surrenders freedom in exchange for security will have neither. The federal leviathan will never look after their personal best interests as well as they would. They become assimilated into a huge amorphous mass of people, leading dull and boring lives simply serving the beast. That may be existence but it is not living.
Some in the press say that we are more divided now that during our Civil War time. While I don't foresee another civil war, I do believe that we as a nation must decide if we intend to remain the constitutional republic we were founded to be and commit to following the Constitution. Or do we make a deliberate decision to jettison our constitutional moorings and launch out into the darkness with no map or compass, destined to become like the failed socialist societies of Europe? I certainly hope not. It does seem to me that time is short and we freedom-loving remnants have a very tight window in which to reclaim our national freedom and liberty and greatness or risk irretrievably losing them forever. It is time for bold action!

Two Roads Diverged...

Several weeks ago Walter Williams remarked while guest-hosting Rush’s show that perhaps it is time to admit that this nation will no longer continue the charade of abiding by the Constitution and simply proclaim that it is null and void. After all, the federal government by its very actions declares that fact every day. Williams pointed out that much, if not most of what the federal government does and spends has no legal basis in any clause of the Constitution. And while the Supreme Court has given the feds the appearance of legal cover on many occasions, no action of the Court has the authority to amend the original text. In short, many of the Courts rulings are simply wrong, either by intention or accident. After all, members of the court are just people, subject to the same personal and political vagaries as the most partisan politician.

What is the Constitution after all? Well, only the document written by the founding states which created the federal government to serve their few collective needs and defined the powers and limits within which it must operate. The states ceded power and authority in those few areas, but retained the final oversight, which is amendment. Power flows from the states to the feds on the states’ terms, not vice versa. That which the states give the states can take back. The drafters never imagined that the federal government would dictate terms to the states and to the people. But just in case they included the 10th Amendment. You know, the one the feds pretend does not exist while it actually does, all the while finding new rights and powers which don’t actually exist but the feds pretend they do via the ‘doctrine’ of penumbras and emanations. A living, evolving document if you will. Poppycock!

Federal officers and officials and judges love to cherry pick the Constitution, abiding by those parts that they like (such as extracting taxes and spending money), while conveniently ignoring the more troublesome parts, like the whole religious freedom thing or the part about the people bearing arms. The trouble with this approach is that the Constitution is like pregnancy. Well, not exactly like it but in one important aspect it is, i.e. a woman can’t be a little bit pregnant. Either she is or she isn’t. Similarly (stay with me), the Constitution is an all or none proposition. It must either be accepted and followed in toto or not at all. To accept anything less is lawlessness which leads to anarchy. In another way it is like the relationship between the Holy Bible, Christianity and Christians. The Bible is God’s written covenant between Himself and His people. For a Christian to ignore or disobey some parts while accepting and following others begs the question of whether that individual is truly a Christian. Can you truly be a Christian if you reject part of God’s Word? Likewise, can this nation truly call itself a lawful constitutional republic if it rejects parts of its foundational law? ‘No’ anyone?
If the nation collectively disagrees with a portion of the Constitution or if times have changed to the point of requiring modification, that is available through amendment. But only through amendment. Unilateral decisions by presidents or Congresses or Supreme Courts cannot and must not be permitted to change the fabric of the document. That is nothing more than rule by fiat, by decree, by the whims of men. And that is disaster. The beauty of our Constitution is its protection of the rights of the minority from the whims of the majority. The ruling majority cannot simply ride roughshod over the lives of those not in power. They cannot trample the God-given birthright of those they disagree with. But, if they are permitted to freely trample the Constitution at will then there is no hedge of protection otherwise available to those standing in their path of destruction. At that point we cease being the United States of (or in, as they used to say) America and have become a Unified State of America, where all power is vested in one federal government which alone dictates the scope of its power and authority. The rights of the citizens are not recognized as deriving from their God, but rather from their government. And what the government gives it can take back. The states have no power, if they even exist in more than name only. The people have no recourse, no ability to petition the government with their grievances for a just redress. Eventually anarchy and tyranny will rule the day. We will have sunk to the basest expression of human depravity. Perhaps, just maybe the drafters knew this about human nature and set about to write a document which took that into account. The document works as long as we all agree to abide by the complete, unaltered manuscript. We must also understand and teach our children that what the Constitution provides for is not pure, unfettered democracy which sounds good to the untrained ear but always leads to tyranny of the majority over the minority; but rather a republic, with democratically elected representatives, and with a Supreme Law that protects the God-given rights of the smallest minority among us. We must elect and appoint and hire people to all levels of government that have a strong sense of morality and ethics and the rule of law, who will respect every dotted-i and crossed-t of the Constitution if there is any hope for the survival of our republic. George Washington understood this when he said that “Religion and morality are the essential pillars of civil society.”

So how about it, is it time to throw in the towel and relegate the Constitution to a resting place in the National Archives? Is it too late to be saved? Can we find enough like-minded people to pool our resources and martial our strengths for one last great hurrah?! Time will tell, in very short order.

How about it Mr. Franklin, have we kept the Republic you gave us? Furthermore, can we keep it?

Technology Hardware/Software Pet Peeves:

The ‘On/Off’ conspiracy. Everyone knows what ‘on’ and ‘off’ mean. Who the heck can remember what the silly little circle and line mean? What’s wrong with ‘on/off?’

Buttons with meaningless symbols on them. Triangles and exclamation marks, etc. Just write on the button what the heck it actually does!

Software applications with goofy names that have no meaning relative to what the application actually does. Can’t we just call things email and calendar and search instead of Lotus Notes and Outlook and Entourage and Google?

Error messages that don’t tell you what the error is, whether it’s even important or not and how you can fix it; or even if you need to or can. If it’s ‘Done, with errors’ what the heck am I supposed to think or do about it?

Help files that don’t have entries for the most common problems that keep popping up.

Trouble-shooting routines that never diagnose or fix the problem.

‘Productivity-enhancing’ applications that are not intuitive. It’s not obvious when you open them how they work or how they’re going to help you accomplish what it is that you want to do. It takes longer to read the instructions and figure out how to make them do what you need done than just doing it the way you always have. You wind up having to adapt your work routine to the application to make it work, rather than the application adapting to your routine. Ultimately it doesn’t really do anything to ‘enhance’ your productivity. All of these types of applications should start with a welcome page that asks, ‘What can I help you do today?’

Applications should communicate in plain logical English sentences and phrases. Just like we all speak and write. The end-user should not have to learn computer geek-speak.

Cryptic key-stroke combinations and hotkeys on the keyboard to make things happen that are totally arbitrary and meaningless.

Applications that try to figure out what you’re trying to do and start doing things and making changes and decisions without your knowledge and permission. It may not even be what you want to do. Then you can’t figure out how to turn it all off and undo what the application has done.

Applications that keep changing my formatting on the fly. Sometimes I want things to stay exactly the way that I created them, even if it doesn’t look right to the application.

Things that don’t print the way that they look on the screen.

Corporate networks that are so secure you can’t get any work done.

So much corporate stuff loading at start-up that it takes 10 minutes to turn on your machine in the morning.

A 100 megabyte QuickTime/iTunes update every week.

Corporate software updates loading every morning when you start your computer.

Default settings that no one would have ever selected and it’s impossible to find how to change them or turn them off. And they keep coming back, even after you change them but then you shut down the application and they go back to the old default when you re-start.

Numbers, letters and characters on microscopic buttons on cell phones/blackberries that no baby boomer can read!

An office telephone that I have to go to a training class on just to know how to use the darn thing!

New and improved, that isn’t. Do designers/developers ever talk to end-users first?

Those canned automated voicemail greetings/menus that go on for 10 minutes before you can leave a message.

I'll Be Forever in Your Debt...

So let me see, the United States federal government is over $13 trillion in debt and racking up over a trillion dollars more each year. Now we learn that in order to try to finance this deficit spending the federal government is going to buy its own debt. Huh? Run that by me again, slowly and with clarity. Let me think, how can the federal government get money to finance its deficit spending? Well, it can raise taxes on the citizens; and it does. But there is a point of diminishing returns that we have certainly already passed. The Laffer curve is real. At high levels of taxation business growth slows, job growth slows, people defer or shelter income and returns to the federal government coffers actually start to shrink. Lower the tax rates and the opposite happens, tax receipts actually grow. This is what Reagan did in the ‘80’s. But that is a discussion for another day.
The next way that the federal government can obtain funds is to sell bonds, T-bills and the like to U.S citizens, people in other countries and governments of other countries. Sell our debt, indenture the nation to a variety of creditors, don’t worry about ever really having to pay off the principle; just keep rolling it over and over to new creditors and pay the interest out of current tax receipts or borrowed money (is there a never-ending loop here?); or via new printed money added to the current money supply. This brings us to the third source of federal revenue: the printing presses.
This is the latest development being announced in the media-- monetizing the debt. The government is the only entity which can legally print its way out of debt. But can it really?? Dumping newly printed money into the current money supply doesn’t really add any new wealth, it’s not backed by anything of substance or value (except the federal government’s promise to pay, to make good on its debt. I know; ROTFL!). All this does is look good for a brief flash in the pan, then the effects ripple out through the economy, artificially inflating the money supply which ultimately only devalues the currency to the extent it was expanded and inflates the cost of everything-- labor and goods and services to the extent of the expansion. The final outcome is runaway inflation. Can you say Weimer Republic? Wheelbarrows full of worthless paper just to buy a loaf of bread. This can happen because our currency is not backed by anything tangible and universally accepted as valuable, such as say, oh something like gold. It’s only backed by the federal government’s, ahem promise to pay. Here we go again.
What would happen if you or I tried to buy all of our debt back? Could we? Well, if we actually had the money to buy our debt back then we really wouldn’t be in debt would we? (Hint Uncle Sam) We can’t raise taxes on our neighbors to buy our debt back. In our case that would be called theft! We probably can’t just keep rolling it over to new creditors because our credibility to pay it back, our promise to pay (which is in reality our credit rating score) would plummet and no one would eventually take our credit. Sort of like the Chinese getting skittish about buying our bonds. Something about that promise to pay thingy. There has actually even been talk about lowering the federal government’s credit rating. Hmmm. Now you and I certainly can’t print money and monetize our debt, well legally anyway. So we’re stuck, we actually have to pay back our debts with real money or file for bankruptcy.
Time to start burying gold in the backyard?

The ‘anchor baby’ provision in the 14^th Amendment (ratified in 1868) was meant to clarify citizenship issues for native Americans and the children of recently emancipated slaves. Granting citizenship to the babies of people here intentionally illegally and then permitting those illegal alien parents to stay in the country to raise their newborn American citizens was not part of the discussion. That concept is bizarre in the least. What national good is to be obtained? The unspoken answer today is that such policies secure potential millions of votes for the ‘compassionate’ Democrats who support such warped and illogical interpretations. There is nothing uniquely ‘American’ about sneaking across our border in the middle of the night just to deliver a baby in the hope of gaining access to our soil and benefits. That is inherently an illegal act. And no, it is not uncaring to ‘punish’ the child for the sins of the parent. The child is a citizen of the parent’s home country and can enjoy all of the duly forthcoming fruits and benefits upon its speedy return. There is no punishment, just level-headed enforcement of the rule of law and common sense. The Constitution and laws of our country are about fairness and equal treatment. They are about preserving our national sovereignty. They are not about enforcing feelings and securing votes for Democrats.

School's In Session

In reply to a local unhappy public school teacher who voted for Obama but is now upset that he is merely continuing the Bush education policies and spending I say,
Public education in this country is a shameful mess. But the problem is not improperly allocated federal resources; but rather the federal government meddling in education in the first place. Education is uniquely a state and local endeavor. The U.S. Constitution grants no positive authority or power to the federal government in the area of education. Thus, under the 10 Amendment (The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.), the feds should not be involved in education in any way, especially financially. Get rid of the Dept. of Education and all federal money and meddling in education and let those resources stay in the states and local communities to begin with. Then work with local school boards to fix the problems.

I Can See Clearly Now!

I just had a revealing Twitter exchange with a woman who is a criminal defense attorney of 35 years in San Francisco and a self-described unrepentant liberal. She initially responded to my complaints about Barack Obama by reminding me that he was elected by a majority of Americans and telling me that I should just get over it. I replied that if a mob does a stupid thing, it is still a stupid thing. There ensued a discussion about democracy, majority rule, the Constitution and a republican form of government. While she avowed her understanding and allegiance to the Constitution and the concept of republican government, all of her arguments trumpeted pure democracy and majority rule. I'm not sure if she was being intentionally disingenuous or really did not understand her contradictions. Either way, it's very disconcerting. I am coming to believe that liberals, Democrats, the ruling class; whatever you want to call them simply believe that if a party or politician wins a majority of support they can go forth and do whatever they darn well please. They believe that winning a majority gives them permission to ignore and subvert the constitutional constraints and limits on their power to do things to the minority. That is pure democracy, which is pure majority rule, which is mob rule, which is tyranny. She was aghast that I would label pure majority rule as mob rule. She felt that I was disavowing the Constitution. How could she have passed Constitutional Law 101? It is this mentality that has lead to the bastardization, misinterpretation and misapplication of the rather narrow Interstate Commerce Clause to give unlimited carte blanche power to the federal government. At the same time they must completely ignore Article 1, Section 8 as if it does not even exist. Liberalism is indeed a mental disorder. It is the ability to hold two diametrically opposing ideas in the mind at the same time with no stress or anxiety. If the Interstate Commerce Clause does give the feds unlimited power to act however the majority chooses, why on earth did the Framers bother to write Article 1, Section 8? Sort of begs the question. It is because the Framers did not intend for the Interstate Commerce Clause to anoint unlimited power upon the federal government! They saw it as merely a means to prohibit the various States from erecting unreasonable limitations to the movement of goods across their borders to and from other States. AND THAT's IT! That understanding is why the Framers then went on to write Article 1, Section 8 to specifically describe the powers and limits of the federal government. The two portions of the Constitution were not mutually exclusive in the minds of the Framers, BUT THEY ARE TO LIBERALS! To liberals, Article 1, Section 8 limits the power of the majority which is why they simply act as if it does not even exist in the Constitution. They vest all of their energy and interest in their bizarre interpretation of the Interstate Commerce Clause because in their minds that gives the majority unfettered power--WHICH IS WHAT THEY SEEK! This woman has made it all perfectly clear. And it doesn't matter whether this mindset is intentional or instinctual, the outcome is the same. And the outcome is just as dangerous, which is why we must resolutely oppose it at every turn.

The announcement that the federal government wants to have everyone's BMI by way of their electronic medical records mandated to begin in 2014 under ObamaScare may just be the "shot heard 'round the world" in this battle over government take-over and conrol of the nation's health care system. The proverbial straw that breaks the camel's back. While on its face it may seem a trifle, the implications and what it reveals about this adminsitration is nothing short of ominous. In true fascist fashion they are all about knowing everything and controlling everything. Period. It's really no more complicated than that. This little BMI announcement is just the camel getting its nose under the tent. (Seem to be a lot of camel references. Well it's appropriate, camels stink!) Time to talk about getting off of the health care grid. Why not set up private clinics/hospitals on Indian Reservations, free of government oversight and control? They already have hotels, golf courses and casinos. People could take their whole family for a week, get their checkup and coronary bypass surgery while the family plays and relaxes. It would be a financial boon to the Reservations (a form of reparations from the evil white man usurpers of the early colonial years) and a way to get your medical care without waiting in line and signing your firstborn male child over to the feds. All done in secret. How could Obama say no to the Indians? And as an added bonus he could get cheap cigarettes to boot!

So I'm in line at the post office on Saturday at 11:20am. There are about three of us waiting and two clerks working with two customers at the windows. I am finally the next in line. The lady at the nearest window walks off and I start walking to the window with my one letter to buy one stamp. The clerk, without saying a word places the "Window Closed" sign in his window, turns around and walks off (probably to take his union required break). I slink back into line and wait for the one remaining clerk to call me forward. And these folks wonder why they get such a bad rap in the blogs? Duh. Even more scary is that this is the mentality that will run ObamaCare, if we allow it to go into practice. Had this been a FedEx agent they would probably have been fired on the spot, and rightfully so. You see, when there is competition for your business customer service is king; but when there is no competition customer service is just a nuisance. God help us.

It is madness to let the federal government have the final say on what the Constitution says and means, vis-a-vis federal powers. The States wrote the Constitution which created the federal government to handle a few specifically described communal needs on behalf of the States. That's it. It was not created to usurp their power and authority over the myriad issues concerning the citizens of those various States. And the federal government certainly was not granted authority to determine what it's powers should and would be over the States and the citizens. That would be madness (just look around us). That which is created can never be greater than that which creates it. The States are not beholden to the federal government; the federal government is beholden to the States. To permit the President, the Congress and the Supreme Court to determine and have final say over what the Constitution says and means and what their powers and authorities are which derive from it, would be like putting children in charge of the cookie jar. Soon there are no more cookies and the kids have tummy aches. Well, our federal government has drained our treasury dry and the nation is quite sick. But don't expect the federal government to fix itself and relinquish power back to the States. Our only hope is for the States to resume their rightful authority and put the federal government back in its place. Soon. Very soon.

Congressman Joe Barton (R-TX) had the audacity to say what is on a lot of people's minds these days. The $20 billion BP fund IS a shakedown for which the President has no constitutional authority. So this time a company (BP) is too big to succeed, not too big to fail. BP's responsibility to clean up the mess and compensate those affected is a private, civil matter not one of federal legal concern. Let the states and localities deal with BP on a case-by-case basis. Meanwhile, what is this congenital proclivity for Republicans to constantly eat their own, to snatch defeat from the jaws of victory? It's an inbred family flaw, sort of like hemophilia in the British royal family. The Dems must be laughing themselves silly in the Congressional cloak-room. Republicans are afraid of their own shadows and all some Democrat has to do is yell 'boo' and Republicans wet their collective pants. Boehner, et al are playing right into Pelosi's hand. Kiss her ring and kiss November goodbye. We out in the trenches are waiting for our guys to grow a set. Why won't we stand up and defend our people when they are right? The Democrats circle the wagons and defend their people even when they shouldn't. They know that blood is thicker than water. If one of our people uses the wrong fork at a state dinner we demand they resign from Congress before sunrise. Come on, this is Chicago thug politics; it's win or die. King For A Day, Year, Term, Life?

The liberal progressives love to talk about the Constitution being a 'living,

breathing' document. How is that possible when they have deliberately

killed it? It's dead as a doornail as my mother would say. Proof of that is

that the current federal government does anything and spends anything it

darn well pleases and any of us that raise constitutional objections to their

behavior are laughed out of Washington. A city named for the man who

had the most reverent respect for the Constitution. We used to talk about

being a nation of laws, not men. History clearly shows that when the whim

of men rule without legal restraint, tyranny and horror follow. The same

holds true for a pure democracy. Simple, unfettered majority rule is merely

anarchy by another name. Actually its worse, its oppression and abuse of

the minority by majority mob rule. That's why our Constitution did not

establish a simple democracy with majority rule. We are a constitutional

representative republic with democratically elected public servants. The

majority is constrained by the mutually agreed to provisions and restrictions

of the Constitution. Furthermore, changing any tenet of the Constitution

is a laborious and time-consuming task, requiring far more than a simple

majority vote. As it should.

So today, with our Constitution essentially relegated to tawdry Saturday

Night Live skits for laughs, we are no longer a national of laws. We are

a nation ruled by the whim of the man-of-the-moment. Right now that

man is Barack Hussein Obama. Whatever he says goes, whatever he

wants he gets. Rule by executive order and regulatory fiat, not by

constitutional principles or even legitimate legislation. Take over private

businesses and industry at the drop of a hat. This is fascist tyranny.

Tomorrow the man (or woman) of the moment might be Mitt Romney

or Sarah Palin or Hillary Clinton or Joe Biden. I don't care who it is,

I don't like it. I don't want to be ruled (vs. governed) by anyone under

such tyrannical circumstances, whether right or left, Republican or

Democrat, conservative or liberal, libertarian or progressive. The rule

of any man, if unfettered will lead to disaster; no matter how seemingly

benevolent or altruistic the original intentions.

In my estimation, the survival of our nation rests upon our ability to

restore the Constitution and the rule of law to its rightful preeminence

in a very short period of time. Failing this, I fear all is lost.

Graduation vs. Innovation

If I were asked to speak to graduates (yeah right) I would give them one idea to take away; our economic society rewards innovation, not graduation. Now I’m not down on education. I’m not down on graduation from high school or college or professional school. Good education is a good thing. It gives you a basic core of general knowledge which is useful in life and it can teach you to think. There is no doubt that the more graduation you have under your belt the more probable it is that you will earn a bit more in the job market than people without some education. But don’t construe that to mean that higher education will automatically lead to wealth, freedom of time, happiness and satisfaction and the creation of a life legacy. Education may give you a marginal advantage at the starting line but by no means guarantees a top finish at the tape. If you don’t take what you have learned and then innovate you will probably settle for a mediocre job with a mediocre income and a mediocre life. You will trade the great life for the good life, which is OK if that’s all you want. Sadly many graduates think that their diploma guarantees them an exceptional income, a big new house, racy cars, fancy clothes and jewelry and glamorous vacations. And it all comes immediately upon graduation. That is a fantasy, sheer nonsense. What is more scary is that easy credit attacks kids right out of school and sucks them in with the ‘you deserve it, you deserve it now and you can have it now,’ mentality. All for easy monthly payments. Forever. These youngsters start living the good life on credit right out of school and think they have the world by the tail. For a while. Then reality sets in. The bills start coming and the payments get bigger and bigger every month. All of a sudden those houses and cars aren’t nearly as glamorous as they originally looked. Maybe our grandparents did know something after all. When they got out of school they rented a small house or apartment, bought a small used car for cash and then worked hard and SAVED their money, living well below their means for many years. And mostly the women didn’t work; they stayed home and took care of the kids. And yet with modest jobs they finished life owning their homes and cars outright with no personal debt and hundreds of thousands of dollars in the bank. Ah, the magic of compounding. Many had boats and summer cabins that they owned free and clear. There were no credit cards when they started their adult lives and when they did arrive on the scene they thought that such things were from the devil. Their philosophy was if you can’t afford it with cash don’t buy it! Save up for a while if you want it and pay cash or forget it, but don’t buy things on credit. Hmmm, wish they could run for public office!

So if you really want to succeed then what is this innovation thing all about? Well, if you look at people that really seem to have succeeded in life (and I’m talking primarily economically right now) most of them have done so by creating a product or service or business that meets a need in society. The more unique and innovative and widely needed it is then generally the more successful that individual will be. You can look at big examples like Henry Ford, Sam Walton, Bill Gates and Steve Jobs, but there are untold thousands who succeed quite handsomely that you never hear about. You don’t have to succeed to the level of one of the giants to live an exceptional life. But you do have to go beyond mere graduation and a mediocre job. And you need to stay out of personal debt. It’s hard to innovate when you can’t pay your bills. So, to be trite; to innovate you are going to have to think outside of the box. Maybe design a new box. And most likely the answer is something outside of your current job if you are employed somewhere. You will probably have to launch out on your own. This is where you will probably be surprised to find that many successful people who own their own businesses may not have much formal education. The old saw that B students wind up working for C students and A students teach is pretty accurate. Many times the C students are more motivated to innovate and launch out on their own because they can’t get a ‘well-paying’ job and if they want to really succeed they have to start their own businesses. With a bit of innovation and long hours of hard work they develop a successful business. They hire B students to work in and run their businesses, but pay them a lot less than they, the entrepreneurial business owner earns. The tables are turned. The A students become tenured professors making a modest income teaching about how to start and run businesses out of textbook theory since they have never really done it. Now of course this is a generalization, but there is a lot of truth in it. Just go out and talk to a lot of business owners. The A and B students can avoid falling into this trap if they understand the concept of innovation. Take what they have learned and go beyond merely looking for a ‘good’ job and innovate and launch a business of their own. Invent something! Then work hard. But remember, hard work alone is not enough. If it was, every maid in every hotel in town would be a millionaire. Hard work must be smart work. It’s not just doing the task right, but doing the right task. Innovate or stagnate!

So, congratulations on graduating. But remember, the world doesn’t owe you anything. You haven’t contributed anything to the world yet. You can’t make a withdrawal until you make a lot of deposits. You may know something now, but you haven’t done anything. And if you don’t you won’t get anything. And you wouldn’t deserve to. Now get out of here and think hard and work hard and innovate; and hopefully you will enjoy the great life!

Based upon what he's said and done since taking office a good case could be made that he is as dumb as a stump. If he is so smart then let's see his school transcripts. Other presidents have released theirs. How come this Einstein-in-Chief won't allow his grades to be released. What does he have to fear? Let's see those straight-A's!

Perhaps things are not as they seem, or as they would like us to believe. Maybe he's just average, or God-forbid, below average. Maybe he went through school on an affirmative action program, not his smarts. Well, inquiring minds want to know. And he's not talking. Which adds to the mystery. People who act like they have something to hide...usually do. People with nothing to hide, well have nothing to hide. Or possibly, his school records might show something adverse about his citizenship, or his parents. We don't really know at this point, which just adds fuel to the rumor mill fires. He could put out those fires by simply releasing his transcripts. Or just maybe, that would fan the flames of those fires.

I'm no wild-eyed rabid 'birther' on the question of Barack Obama's eligibility to serve as President, but his recalcitrance on coming clean with his official birth certificate is of passing interest. The Constitution does require that our President be a natural born U.S. citizen. John McCain, born in the Panama Canal Zone has produced his full birth certificate on several occasions and the U.S. Senate has even passed an opinion on his eligibility. So why all of the secrets Mr. Obama? To date he has not produced the official, original long-form birth certificate from Hawaii, his purported birth state. He has only produced a short 'Certificate of Live Birth' which appears to have been created around 2001. He has also spent a lot of lawyer time and money keeping the original document locked up. It is curious that he would make such a fuss over a simple constitutional requirement that could be cleared up within minutes of releasing the birth certificate. Strange. A number of parties have filed various state and federal lawsuits to try and resolve the issue, most met with laugher and dismissal. To date, none have successfully been able to subpoena the necessary document. Which raises an interesting question in my mind; is it incumbent upon the person seeking the office of President to provide verifiable proof that he is constitutionally eligible to serve (as John McCain has voluntarily done), or is it necessary for some party (say one of the States) to challenge a candidate's eligibility? It would seem to me that the logical answer is that the party positively seeking the office must provide proof of compliance with all constitutional requirements. Why would the country be required to simply accept someone's word as proof positive that they are compliant? Who would lie about such a thing? Hmmm, I wonder. But who would obfuscate as well? And why? And if the party seeking office is not required to provide the proof but rather some party must challenge the question of eligibility, then it would seem that the candidate in question would not be legally able to hide the necessary documents to either exonerate them or prove the questioning parties' case. Isn't that what discovery is all about? And since this is a fundamental constitutional requirement, why can't a party who has standing (such as a State) get their case heard? Why are they all dismissed? We have a crucial, fundamental constitutional question that is unresolved and the courts (the place that these questions are supposed to be resolved) will not allow the issue to be adjudicated. Stranger still. Who's pulling the strings here? So what we are left with is merely the President asserting that he is a natural born United States citizen because...he says he is. "Just take my word for it." As Indiana Jones would say, "Trust me." Well, Mr. Obama, frankly we don't trust you because you have given us no reason to trust you. We have an old saying, trust but verify. We are still waiting on the verify part. And waiting. And waiting.

The other night I was at an event with several hundred people. The ages ran the gamut from babies to great-grandparents, no doubt including a variety of military veterans. At the opening of the festivities we were asked to stand and remove all hats as the band on stage played the National Anthem. An American flag graced the stage. A fair number of us placed our right hands over our left chest to show our respect for the flag and the republic it stands for and for the men and women who have and do serve our country in the armed forces, many having giving the final ultimate sacrifice in defense of our freedoms. Out of the corner of my eye I spied a soldier in his mid-30's outfitted in Army combat fatigues and boots, obviously serving on one of our bases here in town. His wife and two grade-school aged children were there with him. Sadly during the playing of the Star-Spangled Banner he was thumbing through the program, talking to his wife and playing with the kids. Is there no decorum left in our military? Are they not taught the history and heritage of our nation and the branch of the military that they serve in? Shouldn't they be expected to set a public example of respect for our flag and National Anthem? Didn't he realize that those of us around him standing quietly, facing and saluting the flag were doing so out of respect for him and his service? My how far we have come, or fallen. The real question is, where are we headed?

To see our exalted elected servants grilling executives from Goldman-Sachs for possible financial malfeasance is either high comedy or unprecedented hypocrisy. Probably both. Those in the federal government who are responsible, either directly or indirectly for the Goldman Sachs irregularities which might amount to a few billion dollars; are themselves directly responsible for egregious mishandling of public funds to the tune of trillions and trillions of dollars. Yet they puff and preen before the sniveling cameras about these horrid atrocities at Goldman Sachs and others and feign shock and disgust while demanding that justice be done for the good of the people. However, we are expected to look the other way while our paychecks and our kids’ and grandkids’ future livelihoods are ransacked to cover the profligate spending of this Congress and Regime. Pardon me—reaching for airsick bag.
First, isn’t the SEC (a federal government entity) supposed to watch over and regulate these financial entities to protect the people from these sorts of mishaps? That is unless they are too busy watching porn on their government computers during office hours when they are supposed to be protecting us. And doesn’t Congress oversee the SEC? That is unless they are too busy filming porn in their Congressional offices. Adds new meaning to the term ‘watchdog.’
Second, didn’t Chris Dodd, Barney Frank and the CEO’s of Fannie Mae and Freddie Mac (just to mention a few) create this whole financial mess by their dictates to banks about lending requirements and then the bundling and reselling of worthless loan packages? We and Goldman Sachs and many others are where we are today directly because of the malfeasance and misguided directives of the federal government. To see them now berating and threatening executives of these financial institutions that were brought down by such federal policies reeks of historic hubris (everything in this Regime is historic don’t you know). Pot, kettle, black.
Finally, the most egregious financial malfeasance going on today is the federal budget, the deficit and the national debt. That is strictly the responsibility of the Congress and the Regime. They have heaped on trillions of dollars of new debt in a ridiculously short period of time, placing our very national economy and credit worthiness in dire jeopardy while saddling multiple future generations with debt that they cannot possibly ever repay, much less service the interest. Greece’s credit rating has just been reduced to junk status, are we next? If this does not amount to a high crime, or at least a misdemeanor then just exactly what would? Good grief, we put Martha Stewart in prison for peanuts! These federal con artists should be pounding rocks at Leavenworth for many, many years.
No matter how you slice it, our federal and private financial mess is a direct result of the intentional behavior of elected and other public servants. They should be held personally accountable and responsible for the disaster. No Congressional or Executive immunity. Impeach the whole rotten lot them and throw them in the clink for a long, long time!

The Path to Tyranny: Federal Dollars=Federal Mandates

Surprise, surprise, surprise. I wake up the morning after Tea Party Tax Day to read, shazam; god-emperor Barry has issued another mandate. Hospitals (private businesses) that accept insurance payments on behalf of patients from Medicare/Medicaid must now allow visitation and other rights to partners of homosexual patients. Now, some hospitals already do that. Also, I am not personally opposed to such policies. What I am opposed to is a President (or any other government representative) telling private businesses what their policies must be simply based upon the fact that they have received insurance payments from a government health care insurance fund. What’s next, dictating the color of the carpet in the hospital lobby? Does Blue-Cross/Blue-Shield have the same authority to dictate policy to hospitals accepting their payments? I don’t think so. Gee, if I buy a television at Best Buy can I now have them change the color of their employee’s shirts to something more to my liking? These same federal policies permeate all of society, from colleges and universities that accept federal grants or students on federal loans to states which accept federal transportation dollars and must set their speed limits in accordance with federal dictates. How did this all get started?

More importantly, how do we end it? The writing on the wall is becoming crystal clear. This is the path to tyranny. The federal government does not have to pass legislation in the light of day to destroy our freedoms and liberties and impose totalitarian control over every aspect of society. It merely has to subtly and gradually lure every person and every institution into accepting a little federal financial help and before we know it they have their hooks in everything and control it all. That is why Barry is raising taxes, destroying the economy, taking over businesses and passing all of these bailouts. When everyone becomes so strapped that they can’t survive without some kind of government assistance, we take their help and, boom; we are theirs. They can now dictate all sorts of insanity without even having to debate it in Congress and pass laws subject to judicial review. We then have tyranny; totalitarian control over every aspect of society.

We must not only stop this process now, but roll it back. This whole notion that accepting some government money somehow relinquishes control of your business or life to the feds is nonsense and must be squashed. A private business defines its products, services and policies and then says to consumers, ‘If you like what we have and do then come do business with us. If you don’t you are free to take your business elsewhere. But don’t tell me how to run my business. The market will do that.’

Here’s a mandate for Barry and his regime; go straight back to Chicago, do not pass Go and do not collect $200.

Roe v. Wade v. Nebraska

The recent enactment of a law restricting abortion in the state of Nebraska has the pro-abortion zealots in a snit. They supposedly fear for their sacred Roe v. Wade ruling. Don't they realize that the ruling is ancient history? It was handed down in 1973 by seven men. How could old men have anything to say about abortion and women's rights? These rulings are living, breathing things; they change and evolve over time to suit the current societal climate. And everyone knows that they are full of penumbras and emanations that can be twisted into all sorts of interpretations beyond the original text of the ruling. We can't be bound by the strict original text and interpretation; how are we to know what was in the heads of the men who wrote it such a long, long time ago? Not to mention that words meant different things in that era than they do today. No, to hold us to the strict interpretation of that court ruling would mean that we must also apply that same standard to interpreting the original text and meaning of the Constitution. Surely we can't have that. What folly.

Compassion vs. Constitution?

How have we come to the place where compassion or at least purported or perceived compassion trumps the constitution? Why do we look to the federal government instead of our state and local governments for help? Does it have that much better of a track record? I don’t think so. The Founders and Framers never intended for the federal government to be the benefactor of all nice and good things to all people in the country. James Madison remarked that charity is not a befitting function of the federal government. Our Republican form of government hinges on the principle that the government closest to the people best serves their needs. Sadly today that idea has been turned upon its head and Uncle Sam has become Uncle Santa Claus to everyone for nearly everything we need and want. Need a retirement plan? Here’s Social Security. Need medical care? Here’s Medicare and now Obamacare. Just overlook the fact that none of this tomfoolery is authorized to the federal government in the constitution. We have become a nation ruled by whimsy instead of law. The states are perfectly within their rights to offer these goodies to their citizens, so why don’t they. Simple; they don’t have the power to steal money from other states. It takes the strong arm of the federal government to do that. But one can quickly surmise that such a policy is destined for financial insolvency. There just isn’t enough money to go around. And surprisingly (not) Social Security and Medicare are currently bankrupt and soon destined for the ash heap.
If this idea is so great why not, in the name of compassion; give everyone a 3000 square foot home with central air and heat? Why should I have to pay the utilities to heat and light that home? Why not a Mercedes in every one of those garages with free gasoline? How about free lobster and filet minion on all of those tables? Food, housing, transportation, water and electricity are all necessities, so shouldn’t a compassionate society provide them for free, or nearly so? And what’s with this $7.25/hour federal minimum wage? How can you call that compassionate? If we’re going to do it (it’s not authorized in the constitution anyway) then let’s really do it right…jack it up to $50.00/hour! Or why not let everyone take a turn at being CEO of Berkshire Hathaway? Where does the madness end? The mind reels. And there’s the rub, the madness never ends. Giving away other people’s money is akin to a gambling addiction or alcoholism. The deficits and debt just spiral out of control. It used to be that a billion dollars was a big deal, now it’s a trillion, what’s next? We will never pay back our current national debt and it is growing at an unparalleled exponential rate. Let the party rock on!
The constitution was written as a foundational law for the creation and restraint of the power of the federal government. The Framers knew that men, left to their own devices would become corrupt and in turn corrupt the federal government and the nation. We are, after all created a little lower than the angels. If men were angels no government and no constitution would be needed. But being fallen, we need a Supreme Law of the Land. The constitution serves as our fixed point of reference, our anchor, something that doesn’t move or easily change and can be counted on in a storm. For Christians that is the Holy Bible, for Jews the Torah, for Muslims the Koran. For many years this philosophy worked. But as the ratification of the constitution faded into history and new generations of politicians sprang up with no personal memory of the Revolutionary War or the writing of the constitution it became easier and easier to gradually begin to ignore and subvert its purpose and power. What was once revered is not reviled, once sacred now scorned. Politicians today publicly announce their ignorance of constitutional tenets as if that were a badge of honor. Some gleefully and boldly denounce it as a meaningless relic and take great pride in proclaiming their intention to willfully disobey its clear commands. They almost dare someone to call them on it as a show that they can violate this most crucial law with impunity; that the people pose no threat and have no means of reprisal. Those of us who still cling to the notion that Supreme Laws of the Land should probably be obeyed are looked upon by these erudite public servants as some sort of retarded mutant simpletons, throwbacks to a different era and fodder for a good laugh. Surely we and our archaic ideas cannot be taken seriously in this enlightened present day. These hucksters on high will argue that the constitution was meant for a simpler time; the Framers could not possibly have foreseen the complexity of 21st century society. And the amendment process is too slow and cumbersome in such a fast-paced microwave world. Thus it must be viewed as a malleable, living, evolving document which can mean anything to anyone at anytime to fit the need of the current issue at hand. (This of course truly means that it means nothing under such an interpretation.) They see it full of penumbras and emanations only visible to the trained eye of the seasoned politician or activist Supreme Court justice. We simple folk just cannot appreciate the nuances which must have been secreted into the document by the wise Framers. The DaVinci Code has nothing on the Constitution. So today we must entrust the covenant between the people and their federal government to the sole interpretation of basically five people, five Supreme Court judges. We must not question their intellect, their insight, their powers of divination, their motives or their objectivity. They are above mere mortal temptation and could not possibly have a personal or political agenda. What rubbish! The constitution was written in plain language that all can read and understand. It means just exactly what it says and absolutely no more than that. It was written by the people as a covenant document between them and the federal government that they, and thus it created. The people are the ultimate arbiters of the meaning of the constitution, acting through their respective states and state governments. There are no penumbras or emanations and the amendment process was supposed to be long and difficult. The powers of the federal government were supposed to be few and severely constrained while the states retain most of the governing authority. The federal government is supposed to serve the people, not vice versa. Rights come from God, not the government and the role of government is to protect those rights. When governments become abusive of that trust and charge the Declaration of Independence serves as a reminder of how to deal with such tyranny.
My fellow Americans it is time for the people to resume our rightful role as keepers of the constitution and reverse the course of the federal government dictating to us what the constitution says and means and what they are going to do to us and what we must do for them. We the people must loudly proclaim what the constitution says and means and what the federal government is and is not going to do for us. We must take back the constitution and take back our federal government in order to save the republic from decline and ruin, or worse a fall into tyranny. Time is very short, we must act now.

Laying Down the Law

The Constitution is frequently referred to as the ‘Supreme Law of the Land.’ And no doubt, in the purely technical sense of the term it is indeed. But what is a law? It seems to me that a law compels, prohibits or directs the behavior of people to effect a specific outcome. Provided most people are disposed to obey laws, the law will have the desired result. For those people who are not inclined to obey laws the law has a second part—punishment for disobedience. This may be prison, fines or other retribution specified by the law and imposed by the courts. On the first part there can be no doubt that the Constitution is law. It establishes what the President, the Congress and the Federal Courts may and may not do. By virtue of the fact that the document actually creates these entities as well it certainly could be regarded as ‘Supreme.’ Unfortunately, on the second point the Constitution seems somewhat lacking in seeing to its own enforcement and proscribing punishment for failure to comply. Of course, there is the concept of ‘Checks and Balances’ between the three branches of government; however when all three branches are operating in collusion or complicity to violate the tenets of the Constitution, this concept of control becomes moot. Members can be impeached and removed from office for ‘High Crimes and Misdemeanors.’ But again, this is a function of Congress and if Congress is part in parcel with the Constitutional deception this method of enforcement is also found lacking. Just look at how many times it has been used; very few. The ballot box has proved to be a very ineffective method of correcting specific breaches of Constitutional authority. Changes occur very slowly and incrementally as a result of elections and laws once passed or programs once established are rarely, if ever reversed or overturned. Clearly it seems to me that the Framers doubted that any public servant would dare to blatantly disobey the Constitution. They had just fought and won a bloody war to throw off the yoke of a tyrant and establish this new nation by virtue of writing and ratifying the Constitution. They could not foresee that anyone called to serve would have disdain and disregard for the almost sacred document. As a result they must not have presumed a need for strict enforcement and punishment language to be included. The stature of the document would enforce itself they may have believed. For some time, the next generation or two it probably did. Sadly, that is not the case today. I believe that if we are to return the Constitution to its rightful place as the ‘Supreme Law of the Land,’ that task falls upon the States, the original authors. State governments, perhaps acting through an Article V Constitutional Convention must assert their power over the rogue federal government and right the ship before it is hopelessly swamped. I don’t come to this assertion lightly or quickly for I know the inherit dangers of a Constitutional Convention. But I believe that our nation with the current administration has reached a pivotal crossroad necessitating this drastic course of action. The very Constitutional foundation of our Republic and the preservation of freedom and liberty for future generations are at stake. These are desperate and dangerous times and thus demands swift, bold and decisive action. Men of courage must come forth if we are to preserve the nation that we inherited and pass it on intact, strong and free to our children and their children. Time is short.

Are These Truths Self-Evident?

As I sit here on Sunday afternoon, March 21, 2010 I don’t know if the House of Representatives has voted on the Health Care Reform Bill or not; and if they have voted what the outcome was. The much larger matter is that they should not be voting on a measure like this at all. It is simply far beyond the constitutional constraints of the federal government to be contemplating the complete takeover and control of the nation’s health care system. The Constitution and Amendments do not authorize such power. The only thing that Congress could rightfully be debating about health care would be a constitutional amendment to grant such authority to the federal government. Short of that, the matter resides exclusively with the States and the People. At least that’s how the Framer’s saw the role of the federal government, the States and the People within the framework of the Constitution they ratified in 1789.

Across two centuries I hear the Founder’s cries of alarm, warning us that to ignore the clear and absolute wording and intent of the Constitution is worse than folly, it would be the first step on the path to tyranny and despotism. They knew something about that subject, having just freed themselves from the dictatorial fist of a capricious king in England after a protracted and very bloody war. The horrible price of freedom was forefront in their minds as they began to lay the foundation for a new governmental order to be enshrined in the Constitution. Their words and meanings were unambiguous as they carefully crafted each section. They did not intend to put forth a vague outline to be filled in over time by the whims of this man or that, this group or that, this political party or that. No, they knew the fallen state of mankind, the avarice of people and the nature of power. Men are made lower than the angels and no man is immune to temptation and corruption. If men were angels no government would be necessary. Thus they set out to frame a government not of great power over the people, but one constrained from usurping the rights and freedoms of the people; who were to hold power over the government. Government by the consent of the governed. Of the People, by the People and for the People. Government with a very limited, proscribed list of duties, powers and responsibilities; chief of them to protect the rights of the people which are given by God, not the government. No legislation ever passed by the government has given or granted people a right; that is something that can only be granted by God. The only thing granted by government legislation is an entitlement, giving one group of people power and authority to take the money, time, effort or property of another group of people.

Clearly then, those people whom we place in positions of public service within the government must possess a genuine, healthy fear and respect for the Constitution, an absolute understanding of their role, their authority and their constraints according to the text of the document. This is why our Founders were so insistent that only a moral, religious populous was fit to govern itself in this manner.

The Constitution is meant to be a pillar of marble not a lump of clay on a potter’s wheel. It is the Supreme Law of the Land. To violate its precepts is the highest form of lawlessness, if not outright treason. For if we have no deference to the Constitution we have no country; we have anarchy and tyranny. This idea that the Constitution is merely an outline, a malleable lump of clay to be molded by each generation to suit its fancy is dangerous and subversive. The Constitution can be changed for necessities of the current age, but only by the laborious task of amendment. This is by design. A document so fundamental to the inter-generational structure of our government should not be changed easily or quickly for passing whims of the day.

The Constitution belongs to the People, not the federal government. It was written by the People to create the government. That which is created cannot be greater than the creator. It is not the proper role of government to tell the people what the Constitution means and what it empowers the federal government to do for and to the People. Rather, it is the role of the People to tell the federal government what the Constitution authorizes and empowers the federal government to do on behalf of the People, and, more importantly, what the federal government may not do. The Constitution codifies some of the more important rights conferred by God upon the People and charges the federal government to protect those rights. Furthermore, it recognizes in the Ninth Amendment that the list of God-given rights in the Constitution is incomplete, but that other rights given by God are still maintained by the People and in the Tenth Amendment clarifies that those powers and authorities not expressly awarded to the federal government are awarded to the States and the People. And be clear, the authority of the Congress is limited to Article 1, Section 8. The preamble is only a statement of intent; it is an explanation of why Congress is granted those powers in Article 1, Section 8. There are no powers granted in the preamble. In addition, the Necessary and Proper Clause merely empowers Congress to enact legislation to carry out its enumerated duties in Article 1, Section 8. If the Founders, wary of government to begin with, intended to give the federal government unlimited power and authority, why list a few specifics in Article 1, Section 8? That simply makes no sense. The idea that the Framers on the one hand would take the time to list the specific enumerated powers of Congress in Article 1, Section 8 and then on the other hand would grant unlimited power elsewhere in the Constitution is ludicrous. The words mean what they mean. For instance, the infamous Interstate Commerce Clause was intended to empower the federal government to prevent states from erecting unreasonable barriers to commerce between the various states. It was not intended as a carte blanche for the federal government to regulate, tax and direct every manner of business in the nation. Yet today it does just that. I don’t believe that the Framers ever envisioned a concept of penumbras and emanations.

Those men and women that we place in public office who seek to subvert the true original text and meaning of the Constitution, who trot out complex and subtle twists and turns of interpretation to hold it up as a living, changing document are little different that tyrants of old that our Founding Fathers were well acquainted with. They are the same today as then. Human nature has not changed in the last 100 or 1000 or 2000 years. Thus we must be just as vigilant today as 200 years ago for those who seek to bend the rules for personal gain and aggrandizement by trampling on our freedoms and liberties and eating out the very marrow of our nation’s sustenance.

So what are the People to do when an elected President, an elected Congress and even Supreme Court justices appointed by Presidents ignore the Constitution and impose their will upon the People? The Founders must have thought this eventuality beyond the realm of possibility. Given what they had just come through the idea that a public servant, entrusted with the maintenance of our Republic would ignore the very foundation and origin of that Republic must have seemed unfathomable. Once again we must return to the idea that only a moral people can govern themselves within a system such as this. Our public servants must possess a healthy fear and respect for the Constitution, the States and the People. Lacking this, all sorts and manner of mischief are possible and nearly inevitable. The most obvious solution is to vote the tyrants out and elect better servants. One problem with this method is that there are those politicians who run under false pretenses and become something quite contrary to what people thought they were voting for once in office. This seems to be happening with great regularity. In addition, people elected with good intentions sometimes become twisted by the bureaucratic establishment once they get to Washington and become drunk with power and the lust for money, the mother’s milk of politics. On the far other end of the spectrum is armed resistance which is what our Founders had to resort to in the Revolutionary War to ultimately throw off the yoke of tyranny under King George. We also fought a bloody civil war to try to resolve some of our differences. I pray God that we don’t ever get to that point again. In between these two extremes would be an approach that utilizes established remedies that reside mostly with the People acting through their State governments. It is, after all the People acting through the States who wrote the Constitution and established the federal government. It would seem logical that when the federal government will not right itself or yield to the desires of the People the State governments should step in. They can assert their power through the amendment and convention process. This can be a very dangerous procedure if unfriendly factions gain control of a Constitutional Convention and take it off in directions that would be disastrous for the good of the nation. However, given what is happening now inside the government, this might be worth the risk. Could things really get any worse? Perhaps and perhaps not. But I believe that we have arrived at a crossroads in the history of our nation. These are desperate times and may call for desperate measures if we are to preserve our freedoms and liberties; if we are to preserve our Republic and Constitution and pass on something to our children that resembles the nation that we inherited. Our health care system certainly needs some improvement. Given that, though, it is still the best on the face of the earth. And the fixes should be done at the State level with targeted solutions that preserve our freedoms, liberties and the free market system--which is the best hope for providing the most benefit for the most people without bankrupting the nation.

I pray that this will be our finest hour, that we will act in a manner deserving of the trust placed upon us by the Founders and Framers to guard the Republic and Constitution. They have given us a great gift. The question is can we keep it? We cannot afford to lose it.

The Morning/Mourning After Bill

Physician Heal Thyself

In the early 1970's I recall a speaker at one of our PreMed/PreDent Society meetings in college. A physician from Dallas had a warning for we future doctors. He strongly admonished us not to sign contracts with private insurance companies (pre-dates HMO's) or Medicare/Medicaid, not to accept payment from these plans but only direct cash payments from the patients and not to allow these plans to set our fees or demand discounts. We should certainly provide billing statements for the patient to get reimbursed from their insurance providers and for big bills allow them to collect first and then pay us. But our fee is our fee and whatever they can get reimbursed from their insurance plan is what they get. The contract is between the plan and the patient, not the doctor. The physicians should not be parties to insurance payment contracts with patients. Boy was he right! Sadly, because health insurance became tied to employment without the option of portability or the ability to buy across state lines or the ability of small groups to band together to buy cheaper policies; large insurance companies began going to large employers, signing up their huge workforce and then going to doctors demanding contracts with them for discounts and set fees in order for the doctor to keep his patients and the patient to keep their doctor. Nothing more than high-tone extortion of the doctors by the insurance companies. During that time period the American Medical Association represented about 70% of U.S. physicians but was totally ineffective in heading off this bastardization of the physician-patient relationship. It was during this same time that MediCare instituted Diagnosis Related Groups (DRG's) which dictated to doctors and hospitals how they could treat patients for various afflictions and how long they could be kept in the hospital. Again, the A.M.A. was unable to avert this train wreck. This heralded the decline of the influence of the A.M.A. as its leadership was taken over more and more by leftists in bed with the government. Membership began to bleed off to the point today where only about 17% of U.S. physicians belong. Yet the media and government love to run to the 'doctor's union' anytime they want to report what doctors think about this or that. Pure poppycock. It is now a toothless tiger. The fact that virtually all physicians are under contract with myriad insurance plans and with Medicare/Medicaid, that their fees are set by these entities, that they must accept discounted fees to be allowed onto the plans and that many practices are actually owned outright by the plans thus making the physicians merely employees or contractors has totally perverted the cost/price/value equation beyond recognition. This is one factor responsible for ballooning health care costs; the separation of the provider from the consumer in the payment of fees for services rendered. Doctors don't know how much stuff costs and neither do the patients. People don't know if they're getting a good deal or not. All the doctor knows is that many times he has to argue with some non-physician to get a test done. If the doctor and patient know exactly what everything costs they can sit down and discuss the treatment plan and various options that provide the best care for the best price. Giving the patient more choices in the health insurance marketplace by allowing portability from the severing of health insurance from employment, allowing insurance companies to sell across state lines and allowing small groups to band together and buy better priced large policies would be a good start in bringing down the cost of health care and health insurance and making it available to a larger segment of society. In addition, getting the doctors out of the insurance picture by ending physician contracting and fee setting, having doctors be paid directly by the patients who then get reimbursed by their insurance plan at whatever rate they have agreed to would help the cause as well. Also, let individuals set up medical savings accounts similar to their IRA's. Finally, rational tort reform and scaling back onerous taxes and regulations on pharmaceutical and medical equipment manufacturers would complete the reform picture.

Rights vs. Entitlements

A Right does not require the time, money, property or effort of other people. Entitlements do. Stop and think; Life, Liberty, the Pursuit of Happiness, Free Speech, Freedom of Religion, Freedom of Assembly, Freedom from Unreasonable Search & Seizure, the Right to Bear Arms; all Rights referenced in the Constitution and Bill of Rights and none require input from other people. On the other hand; Medicare, Social Security, Universal Health Care, Food Stamps, Unemployment Insurance, Federal Minimum Wage, Housing Subsidies, Transportation Subsidies, Education Subsidies; all require something (mostly tax money) from other people; and all Entitlements.

In the current debate it is disingenuous to call for a Right to Health Care. Universal Federal Health Care/Insurance cannot be a right; it requires time, money and effort of other people. It is just another entitlement. And it is an entitlement which the U.S. Constitution does not empower or authorize the federal government to provide. (Frankly, most other federal entitlements actually are not authorized by the Constitution either) Thus, it could only be provided by the States or the Federal Government following passage of an empowering Constitutional Amendment.

Next Steps

Now that we have said ‘B’ what is next? One option is to do nothing and maintain the status quo. This course of action enshrines disregard of the Constitution and the rule of law as accepted practice and policy of the federal government. What a wonderful example to set for our children and precedent to set for how to govern. Legislation by whimsy. Sadly, this is essentially what we have now and have had for about a hundred years. And look at the mess we are in. This is the most intellectually bankrupt and thus the easiest course of action and probably what our federal government will take, short of some compelling outside force intervening to the contrary. The second possibility would be to simply disband the patently bankrupt Medicare and Social Security programs at once and let the chips fall where they may. States could pick up the programs if they so chose. While this would be the strictly correct thing to do according to the Constitution, it would ignore the millions of older Americans who have spent their entire adult lives planning and paying (well not really, but that’s another discussion) for their retirement and medical care through these programs. To suddenly drop them like a hot potato would be simply unthinkable. You don’t right a wrong with another wrong. The third option would be to begin a process of phasing out these programs by systematically privatizing portions of them and rolling the other functions to the states. New entrants into the workforce should not be enrolled in these federal programs but rather in the new state-run privatized programs. Workers already enrolled in the federal programs would have their benefits paid as promised, but no new federal commitments would be incurred. Hopefully the states could find better ways to run and fund these programs with some degree of fiscal solvency. It is time to quite throwing good money after bad and start actually following the law. What a concept.

Who Says 'A' Must Say 'B' --WFB, Jr.

William F. Buckley, Jr. often admonished people that who says ‘A’ must say ‘B.’ The gist being that ideas and thoughts have logical natural consequences. Sometimes these consequences are not what the person had in mind when postulating ‘A.’ Many conservatives today make the argument (and quite correctly I might add) that the health care reform bills winding their way through Congress are patently unconstitutional. I believe that this position is correct within the scope of Article 1, Section 8 and the 10^th Amendment. The federal government simply lacks the authority and power to engage in these activities and to compel citizens to do or not do certain things relative to health care. The states, on the other hand would be free to pursue universal health care plans within the confines of their borders and according to their state constitutional dictates. Having posited all of this, now who says ‘A’ must say ‘B.’ Under these same U.S. constitutional proscriptions I believe that Medicare and Social Security must also be viewed in the same light; unconstitutional. They simply are not specific enumerated powers of the federal government under Article 1, Section 8. And please don’t bring up the preamble, the general welfare clause, the necessary and proper clause or the interstate commerce clause. These attempts to subvert the clear language and intent of Article 1, Section 8 have been debated to death and handily dispatched. In addition, I realize that various Supreme Courts have ruled several times in the past to uphold the constitutionality of these programs. This merely speaks to the fallibility of the court. The court is composed of mere mortals and numerous courts have been reversed and nullified. I maintain that the court is every bit as political as the executive and legislative branches. Justices are appointed by Presidents to further the administration’s agenda. And over time I believe that justices embark upon crusades for their own personal agendas. To believe that the court is painfully objective and unbiased in its decisions and rigorously faithful to the actual text and original intent of the Constitution is at best laughable and at worst dangerous. Thus, I call upon my fellow conservative revolutionaries to carry our crusade against a federal health care takeover to the next logical step of disbanding Medicare and Social Security (hopelessly bankrupt as they are) and giving the states the opportunity of taking over these types of programs if they see fit.

Profiling has nothing to do with race or religion. It is a rational, intelligent approach to dealing with threat patterns and probabilities to try to prevent bad things from happening. I believe that the Congress and Obama Administration have profoundly underestimated the groundswell of grassroots opposition to this illegal, unconstitutional monstrosity called a federal health care reform bill. If this bill passes, it may become the proverbial line in the sand, the final straw that breaks the camel’s back, the crossing of the Rubicon, the burning of the ships and bridges, the shot heard round the world. This could be an 1860 moment in history. We are fast approaching a critical mass of opposition to the slide away from our constitutional moorings that began under Woodrow Wilson and accelerated under Franklin Roosevelt. The disrespect and utter contempt that our current ‘public servants’ display for the Constitution, the rule of law and the people who still adhere to the Constitution’s tenets is unparalleled. In my lifetime I have never seen such condescending, flippant attitudes toward our heritage and the body politic. It chills me to the bone.

In short, the Constitution simply does not allow this bill and at least 57% of the American people say they don’t want it. Do our ‘leaders’ give credence to either, much less both realities? No, they spit upon the Constitution and in the eyes of the people they serve, who put them where they are and pay their salaries. Hell must have a special place reserved for such as these. They are not fit to ‘serve.’ They should be removed from office immediately, if not imprisoned for violation of the Supreme Law of the Land. Mark my words, with God as my witness a day of reckoning is coming. A sleeping giant is awakening. We have endured the intentional erosion of our God-given freedoms and liberties by our federal government longer than any people should have to and remain obedient. Our very Declaration of Independence proclaimed that mankind is more inclined to suffer abuses as long as they are sufferable rather than take drastic action to right them and perhaps alter or throw off an abusive government and form a new one. But, it warns that when such abuses become so egregious and long-standing then people have not only a right but a duty to take such action as is necessary to alter or abolish the offending government and institute such changes or new form of government as is necessary to redress the injustices. The patience of the American people is growing strained and thin.

Many pundits tell us that we should direct our remedial anger to the ballot box; throw the bad seed out and replace them with better politicians. Sadly, we have been trying this for over 200 years and the situation only grows more dire with each passing election. The federal behemoth has taken on a life all its own, consuming well-meaning politicians and amassing more power unchecked and unhindered by the tinkering of elected officials who quickly come and go. It overruns checks and balances, ignores constitutional restraints and intimidates the states into submission while it sucks out their very sustenance; bringing everyone and everything under its control. There is hardly any nook or cranny of existence that the federal government does regulate, control or tax. This was explicitly not the intent of the framers. The federal government was to have a few specific enumerated powers necessary for the good of all the people and states, but very limited and constrained by Article 1, Section 8 of the Constitution. The states, on the other hand were to be the laboratories of democracy. They wrote the Constitution that created the federal government for their benefit and to serve their purposes, not vice versa. They are not mere political subdivisions of the federal government. They are the sovereign governing bodies with the most power; being closer to the people they serve. It is ludicrous for the federal government to dare think that it can order them around, trample their authority and direct them to raise taxes and spend money against their will. But that is exactly what has happened. With the clarity of the 10^th Amendment I cannot for the life of me understand why the states have cowered so before the federal altar. No doubt it is due in large part to the boatloads of money (that ironically comes out of the pockets of taxpayers in the several states) that the federal government dangles in front of the states, asking only in return their complicity and acquiescence to unlimited federal power. It is time for the states to reassert their supremacy and return the federal government to its appropriate constitutional role. We must remind those in Washington that they serve by the consent of the governed, not in spite of them. The federal government must once again have a healthy fear of the states and the people it serves instead of the people fearing the federal government. A letter from a citizen to an elected servant should strike infinitely more fear in their hearts than a letter to a citizen from the Internal Revenue Service.

If ballots are ineffective in bringing about the needed change, what other means do we have at our disposal? First of all, surely not bullets as was the case in 1860. Then how about defunding the government? Well, the people lost the power to defund the government by withholding our ‘voluntary’ income tax payments when, during World War II a temporary, emergency process was instituted requiring employers to withhold and send in tax payments automatically on behalf of their employees to insure a continuing stream of money into federal coffers to fund the war effort. Apparently, word of the end of the war in 1945 has not yet reached Washington, as this ‘temporary, emergency’ measure is still in force. Word to the wise, a federal program once begun never ends. The next closest thing to immortality after personal salvation is a federal program. Additionally, I seriously doubt that enough companies would band together and withhold the payments to make any sort of dent in the revenue or statement to the elected officials. And don’t look to the federal courts for any help. In my opinion federal judges, including Supreme Court justices are merely political appointees with personal agendas ensconced for life and accountable to no one. Then what about civil disobedience? Would enough doctors refuse to participate in this health reform fiasco to make a difference? Would enough people or companies or states refuse to participate to make a statement? Would enough companies refuse to participate in Cap &Trade to make it null and void? How would such movements be organized and implemented? What would be the federal government’s response? No one really knows. It would seem that given the history of our separation from England, the writing of the Constitution and the formation of the federal government, we should direct our hope to the states. After all, the 10^th Amendment clearly gives all powers not specifically allocated to the federal government to the states. If the framers had intended for the Constitution to be a blank check of power to the federal government (Article 1, Section 8 notwithstanding), then why a 10^th Amendment? The answer, of course is that they never intended for the federal government to amass such power and control over the day-to-day lives, fortunes and businesses of the American people. They would never have dreamed that the reach of this central government they had created would become so all encompassing. To safeguard any such eventuality they spelled out the specific powers it was to possess in the body of the Constitution and then added an additional safeguard in the 10^th Amendment, ensuring that the states would have the final say in the unlikely event the federal government were to attempt to overstep its bounds. The ultimate expression of state power is the constitutional amendment, the only legitimate path to altering the express or implied meaning of the Constitution. I believe that the framers thought that the federal government would have such respect for the supremacy and almost sanctity of the Constitution and fear of the people that it would never dream of grossly overstepping its authority. This belief was based upon the idea that a representative democracy such as this could only function successfully if the population was informed, engaged and moral. Sadly the liberal control of education over the last 50-60 years has resulted in a pathetic misunderstanding of our nation’s history, heritage, economic and political structure within a large segment of our population. One only has to look at the behavior of our politicians over the last decades to realize that any moral foundation has been utterly lost. In addition, the blurring of lines between political parties and the feeling of a single person’s helplessness in the face of a gigantic federal juggernaut has instilled a pervasive apathy (until very recently) across the electorate.

Is sufficient time left for the people to organize and seize the reins of their state governments so as to reassert their rightful power over the runaway federal government under the aegis of the 10^th Amendment? Or have we already passed the point of no return down the slippery slope to socialism, decay and demise? Only the passage of the next few years will tell. There are signs that people are beginning to awaken to the reality of what is happening. History tells us only about 2% of the American colonists actively supported the Revolution. That would be about 6 million people today, fewer by far than listen to Rush Limbaugh alone in a week. The hope for the survival of the Republic and a future for our children and grandchildren hang on these. We must encourage them to educate and enlist others in this fight. We must peacefully resist the illegal encroachments of the federal government when and where possible. We must organize and move to nudge or take control of state governments to reassert their constitutional power and authority. This is a fight we cannot and must not lose, for as John Adam’s character in “1776” ponders;

A Christmas Eve Prayer

The little altar had gone up alongside a street not far from my home sometime in the spring of 2009. I remember glancing over the article in the paper about a single car accident late one night. Two college-age young men were thrown from the car, the passenger died at the scene and the driver suffered serious, but survivable injuries. Out late partying, I don’t know if alcohol was a factor, not wearing seat belts, driving too fast; a momentary mistake and one young life ends tragically and the other must live the rest of his life with the memory that he is responsible for his friend’s death. According to the article the boy who died had been a local high school track star, played hockey and had just started his college studies at a local university.
As the weeks went by friends and family added to the growing altar. A large plastic-covered picture of the boy in his hockey jersey appeared. A wooden cross with his name and the two dates defining his short life inscribed on it was set into the ground. Then pair of track shoes painted gold were hung on the cross. A large rock with names and messages from friends was placed at its base. Over time flowers both real and artificial came and went. Stuffed teddy bears adorned the shrine. He obviously had meant much to many people. As the months turned into fall and winter approached the weather took its toll on the various items arranged around the altar. By Christmas Eve only the cross, bent somewhat by the wind and the rock remained as a reminder to his existence.
I was driving home from the bank about noon on Christmas Eve, mad at myself, mad at God, mad at the government, mad at the economy—and mad for being mad on Christmas Eve. The year 2009 had not been a good one financially. Our incomes were down, business revenue was down and debts were mounting. This at a time I was looking at having several teenagers approaching college soon. Repairs were desperately needed around the house and for the cars. In fact, one of the cars really needed to be replaced fairly soon. Trying to have a decent Christmas, buy food and pay bills were all weighing heavily on my shoulders on the eve of this the happiest day of the year. At that moment I passed the little altar on the side of the road and noticed a pick-up truck parked nearby. A middle-aged woman was bent over straightening out the cross and placing some fresh flowers around its base. No doubt his mother, contemplating her first Christmas without her son and the many Christmases yet to come without him and the children he might have had.
At that moment I was overtaken with a crystal clear revelation of life and Christmas that put my problems and anger into an appropriate perspective. The tears welled up in my eyes and came rolling out uncontrollably. I began to weep for this woman and her family and the loss they had suffered. I was also weeping for my pettiness over my perceived losses. Her loss was real and permanent while my losses were minor and fleeting. Compared to a life money has no real value, it is temporary, it comes and goes. It is something that with time and hard work you can replace many times over. Her son can never be replaced here on planet Earth. I said a silent prayer for the mother and her family, for peace and comfort in the hope of some day being reunited with the young man. I also said a prayer for me and my family, apologizing for my selfish attitude. I asked God for help in our present economic difficulties, but also asked him to help me keep a proper perspective on my life and family and our problems and blessings relative to real hurt and suffering in the world.
God has a way of finding just the right time and place and message for getting our attention to make a point right when we need it most. In our busy lives I think that we are sometimes waiting for a bright, loud magnificent proclamation from God to get our attention and speak into our lives. In doing so, we risk missing the many little whispers and subtle nudges of the Holy Spirit trying to steer us in the right direction. In the coming year I will certainly be working hard and praying hard to provide for my family and give as much to help the less fortunate in our midst as I possibly can. And I will also be praying that I never forget the sight of the woman bending over the little cross by the side of the road and what a profound message from God I heard that day.

Bill Buckley was right when he lamented that when the middle class realizes that it can vote itself subsidies from the public treasury, we are then doomed.

The Constitution is in shreds and the concept of a nation of laws not of men has been jettisoned. We have an MTV/American Idol buffoon for a president all dressed up like Santa Claus. The problem is that he is really just a Chicago street thug taking goodies out of your sack to give to his adoring followers. In the good old days we recognized that for what it really is; theft. And we knew how to deal with it; prison.

So the three stooges do their comedy routines in front of the cameras to distract Americans while the country burns to the ground. I can’t quite decide if we are watching Rome burn while Barry piddles or if this is 1789 France. Let’s just pray that we all come to our senses before heads roll.

I and many other conservatives believe that this health bill must be opposed in its entirety on constitutional grounds. Quite simply, the federal government has no constitutional power or authority to be involved in health care delivery or regulation or the provision or regulation of health insurance. This would include the current bill before the senate as well as MediCare/MediCaid. (And Social Security and a federal minimum wage; but those are battles for another day) To argue any less is tantamount to an admission that the Constitution is null and void and we are no longer a nation of laws but now rather of men. This will ultimately lead to tyranny and anarchy. These issues are rightly reserved to the States, barring a constitutional amendment. Seeing no amendment movement on the horizon the federal government must cease and desist from this illegal pursuit. Surely someone in the D.C. vacuum must realize that these activities contribute greatly to the current 71% mistrust level of the federal government among the People. Mark my words, a movement is brewing based upon the 10^th Amendment, the States and the People to retake our federal government and reinstate the Constitution, with or without the cooperation of the Congress, President and Courts. The People and the States created the federal government to serve them, not dominate and oppress them. We expect our creation to obey the rules that we set out for it in the Constitution, to the letter. So very much of what the federal government does and spends today falls outside of its Constitutional authority. Understand, the People have had enough of it. This is the proverbial line in the sand. I am seeing more and more articles in papers, letters to the editor and writings in blogs comparing the current state of our nation to the times of the Revolutionary or Civil Wars. While I don’t think we have reached that degree of disagreement yet, there are some valid points and comparisons. And I am certainly not calling for a violent revolt or overthrow of our federal government. However, I do disagree with those who posit that such an eventuality could never happen here again. Or, that some States might choose separation in lieu of remaining in a socialist or fascist nation. In my estimation, human nature, emotions and passions have not changed in thousands of years. The same ideas and fears that launched those conflicts are still very real and very much alive today. As the writers of the Declaration of Independence related, we Americans are very tolerant and disposed to suffer rather than take hasty action. There is a point, though; at which something must be done. The United States has been slipping free from its constitutional moorings for decades due to the natural tendency of governments to amass more power and the refusal of the States to squash such efforts. We have suffered higher taxes, bloated deficit spending and ridiculous government regulation and intervention in business and the marketplace for far too many years. The current Obama administration has taken this effort to new heights with ferocious speed. We now have trillion dollar deficits as far as the eye can see, government takeovers of banks and automobile companies, pay czars, diversity czars, insane Cap & Trade bills, an attempted takeover and socialization of our health care industry; in short nationalization of the private business and lives all American citizens. This is blatant fascism! I firmly believe that the current administration does not like the way the United States of America is constituted and seeks to completely remake American in its perverted image. This administration regards the Constitution as a bad joke perpetrated upon the American people. Seeing the States unwillingness to hold its feet to the constitutional fire, this administration essentially ignores the Constitution and its restrictions, laughs it off as an old, irrelevant, living, evolving, pliable document (written by white male slave owners) and ridicules anyone who actually still holds to its tenets. The philosophy in D.C. is that the federal government can do anything it wants to do and no one and nothing can stop it. If the Constitution gets in the way, trample and ignore it. After all, what are the consequences? Well, up to this point, none. If the Supreme Court (a bunch of political appointees with personal agendas) or the States won’t enforce the supreme rule of law upon the Congress and the President, what are the mere People to do? Thus, the stage is set for fascism, tyranny and ultimately, anarchy. Yes, the People elected this President and Congress; but with the expectation that they would act within their legally defined authority under the constraints of the Constitution. Now that we are beyond that point, we very quickly are becoming a nation of men, not laws. Don’t forget, we are a Constitutional Republic with democratically elected representatives, whose power and authority is bound by the limits of the Constitution. We are not a pure democracy; which always leads to the tyranny of the majority over the minority. When the highest elected officials of the land will not obey the most sacred and fundamental laws of our nation, why would they expect the People to act any differently (or better)? The question of 2010 is whether the ballot box will be able to stop and reverse this dangerous slide we have begun into fascism and tyranny. If a major reversal occurs in that election, followed by another in 2012, we may avert a constitutional disaster. That would require the undoing of decades of creeping lawless socialism in our federal government, regulations and statutes. This would amount to a bloodless coup to overthrow the Obama/Pelosi/Reid troika. If this juggernaut is not stopped at the ballot box, however; the path to secession movements or other action may fall into place. I fervently pray this does not happen.

I have written at great length about the anti-constitutional usurpation of power by the federal government over the past many years. In my, and many others’ opinion the federal government exceeds its constitutional authority to act and spend in the majority of what it does, aided and abetted by a usually complicit President and a sycophantic Supreme Court composed of blatant political appointees with rabid agendas. The notion that the Court is objective and removed from the vagaries of politics is absurd. The reach of the current federal government far exceeds anything conceived of by even those founding fathers with the most inclination to a strong centralized government. The bastardization of the Constitution, the trampling of the State’s rights and the abrogation of the People’s freedoms has of late reached epic proportions. The health care juggernaut currently consuming the Congress may well be the final straw to prophetically break the camel’s back. It is a truly sad and pathetic commentary on the state of politicians today when legitimate questions brought to them about the constitutional authority to act as they are is laughed off as being silly and lacking any seriousness while the questioners are derided and lampooned as simpletons and fools. This is how our public servants treat those who put them in office, pay their salaries and place their trust in them to do the right thing for the country. The world is truly turned upside down. In addition, to hear the contorted explanations of politicians (most lawyers) as to the purported constitutional authority to act merely affirms the pathetic level of constitutional legal education in our nation’s law schools. Or worse, they actually know the truth but think that they can bamboozle the ‘little people’ with byzantine explanations. Well, we will not be bamboozled! The Constitution was written in plain English; it is not that difficult for the common man to understand. And what the common man understands is that this federal government is acting outside and beyond its legal authority, taking and spending money it has no right to and destroying rights and liberties which come not from the government, but from God. The Constitution promises to protect these rights of the ‘common man’ from abuses of government, not protect the government from the will or wrath of the People. It is not the role of the federal government (whether through Congress, the President or the Supreme Court) to be the final dictator of what the Constitution says and means. These entities are created by the Constitution and thus lesser and subservient to it. They cannot rule on what it means and how it applies to them. That is reserved to the People acting through the States. The States, after all wrote the Constitution thereby creating the federal government to serve them and their respective citizens. That is why our country was originally referred to as the United States IN America, not OF America.
As to our current debate, the federal government has no constitutional role in providing for, insuring for or regulating health care. That is strictly a state-by-state issue. And yes, that would also apply to Medicare and Medicaid. That a Supreme Court ruled on their constitutionality only proves their criminal collusion. Programs such as Social Security and a federal minimum wage also fail the test, but that is a fight for another day. Arguments trotted out by our nefarious Congressional spokesmen about the General Welfare Clause of the Preamble, the fabulously abused Interstate Commerce Clause or the Necessary and Proper Clause are breathtaking only in the audacity of their being brought forth and they are convincing not in the least. As I mentioned earlier, such proclamations are either a testament to enormous intentional chutzpah or a symptom of the decline and fall of constitutional education in the law schools. At any rate, while the current Congress many ram through some health care bill, have this fascist buffoon of a so-called President sign it and no doubt the lackey Supreme Court will give it a false imprimatur of legality; the People and the States will ultimately have none of it. Mark these words, a movement is coming, based upon our founding principles as spelled out in the Declaration of Independence to turn back this tide of creeping federal cannibalism and restore the tenets of the Constitution to their rightful place. It will be a movement of the People and the States. We will once again make it clear that the Constitution means exactly what it says. It is not a living evolving document. It can only be changed by the proper amendment process. If Congress does not have the will to propose a Constitutional Amendment to take over the health care system, then it must leave hands off and let the States and the People see to it. We are on the precipice of becoming a nation, not of laws, but of men. In other words, tyranny which will rapidly devolve into anarchy. The Constitution is the only instrument which separates us from rule at the end of a gun barrel. Right now, the Constitution is barely hanging on by a frayed thread. If the federal government can do anything it wants to We the People simply by virtue of proclaiming that it can and will, without Constitutional restraint; then we are truly adrift on a tempest-tossed sea with no sail, no map and no rudder. The Republic is on the verge of collapse. If that be the case, then only God can help us. Let us pray that we soon come to our senses. God save the Constitution, God save the Republic and God bless America.

What happened to the concept of 'public servant?' Why do we fear them instead of them fearing us? Special parking spots, special passes at airports, special medical benefits, special retirement benefits, special dining facilities, special barber and beauty shops, special post offices. Why? Why? Why? We the People should be elevated above them, they are supposed to serve us. They should have to navigate society like everyone else. Instead they have become some sort of uber-class; above us and above the law. Charlie Rangel should be in jail! Instead his peers won't even boot him off of a committee, much less the Congress! These people tell us what they are going to do to us whether we want it or not. These people tell us how much of our money they are going to steal from us whether we want that or not. These people tell us what the Constitution says and what rights they are going to permit us to have or not. ENOUGH! STOP! WHOA! Beyond the question of why Barack inserted himself in the whole Chicago Olympic mess to begin with (surely not so that his well-healed Chicago donors could unload worthless slum properties for millions as sites on which to build Olympic facilities and venues); why did he have to fly himself, his entourage, several jets, his wife and her entourage to Copenhagen to make the plea? Couldn't he just simply have picked up the phone and called the Committee? It is said that the bill for the jet fuel alone is $1.5 million. How much health care for underprivileged Chicagoans would that buy?

With a clear understanding of the history of the writing of the U.S. Constitution, I as a legitimate party to that covenant and upon close inspection finding no mention of health care or health insurance; demand that the federal government cease and desist any intrusion into these areas until and unless an amendment to the U.S. Constitution has been duly passed granting such authority to the federal government. And yes, I seriously believe that this stipulation would apply to Medicare, and by extension; to such programs as Social Security and the federal minimum wage.

Now that the election is behind us President B.Hussein O. may be learning just who his voters were as opposed to his current supporters. For the election A.C.O.R.N. and S.E.I.U. were able to round up welfare recipients and 18-24 year-old M.T.V. junkies to go down and vote for his hinney-ness. Those people are now predictably M.I.A. They are not actively engaged citizens who read political punditry, call their Senators and write their Congressmen. They don't attend town-hall meetings or go to political rallies. The don't follow the intricacies of Cap & Trade legislation or study the finer points of the Interstate Commerce Clause. BHO seems totally shocked by the evaporation of his base on Health Care Reform and other wacko lefty initiatives so dear to his heart. There is nothing mysterious about this phenomenon at all. These people thought that they were voting for a performer on American Idol. Well, guess what? This dude ain't got talent. These fickle voters are ready for the next episode and the next contestant. They are done with him. He's all fizzle and no sizzle. If this was the Gong Show the mallet would be swinging. Time for him to bow and exit...stage...left.

Five political appointees in black robes do not unmake the Constitution. There is no such thing as the Supreme Court, there are only nine justices. People who are imperfect and biased. When the justices function within the boundaries of the Constitution I respect their opinions. When they stray beyond those boundaries, which they have many times I have no respect for their opinions. They then become part of the problem instead of the solution. It is the duty of the President and Congress to reign in the justices when they exceed their assigned authority. There are many horrific rulings which need to be nullified. They do not own the Constitution or have the final, ultimate say about what it means. The Constitution is a contract between the States, which wrote the Constitution and thus created the Federal Government; and the People. The Supreme Court is not a party to that contract. We can all read it and understand what it means. It's time for the People to take back their Constitution and put the Supreme Court, the Congress and the President in their respective places. Which is the back seat, not the driver's seat.
